If the Intermediary is a

private entity and the Focal Point shows that it has and is

taking appropriate measures to recover the funds from the

Intermediary, the Financial Mechanism Committee can decide to

give the Focal Point up to one year to reimburse the requested

funds. In such a case, the Financial Mechanism Committee can also

decide to contribute up to 50% of reasonable legal fees related

to the recovery of the funds from the Intermediary.
