Nobeiguma noteikumi

1. Šī Vienošanās stājas spēkā pēc

tam, kad Latvijas puse ir saņēmusi Grieķijas puses paziņojumu par

to, ka tā ir veikusi visas iekšējās vietējās procedūras, lai šī

Vienošanās stātos spēkā. Šī Vienošanās paliek spēkā neierobežotu

laiku, ja vien Puses nevienojas citādi.

2. Šo Vienošanos var grozīt

jebkurā laikā, Pusēm rakstiski savstarpēji vienojoties, un šie

grozījumi stājās spēkā atbilstoši šā panta pirmās daļas

noteikumiem.

3. Jebkura no Pusēm var izbeigt šo

Vienošanos, sešus mēnešus iepriekš rakstiski brīdinot otru Pusi.

Šajā gadījumā saskaņā ar šo Vienošanos Puses uzsāk sarunas, lai

noregulētu visas nenokārtotās savstarpējās finanšu saistības,

prasības, domstarpības un drošības jautājumus.

4. Šīs Vienošanās izbeigšanas

gadījumā visa klasificētā informācija, ar kuru apmainās vai kuru

rada šīs Vienošanās ietvaros, turpinās tikt aizsargāta.

5. Pēc šīs Vienošanās stāšanās

spēkā Latvijas Republikas Aizsardzības ministrijas un Grieķijas

Republikas Nacionālās aizsardzības ministrijas vienošanās par

attiecību un kontaktu attīstību militārās sadarbības jomā, kas

parakstīta Atēnās 1999.gada 17.martā, zaudē spēku.

Parakstītā divos oriģinālos

eksemplāros angļu valodā, pa vienam katrai Pusei.

MEMORANDUM OF

UNDERSTANDING BETWEEN

THE MINISTRY OF DEFENCE OF THE REPUBLIC OF LATVIA AND

THE MINISTER OF DEFENCE OF THE KINGDOM OF THE NETHERLANDS

CONCERNING COOPERATION IN THE FIELD OF DEFENCE AND MILITARY

RELATIONS

INTRODUCTION

The Ministry of Defence of the

Republic of Latvia and the Minister of Defence of the Kingdom of

Netherlands, hereinafter called "the Participants"

Having regard to the provisions of

the North Atlantic Treaty, dated 4th April, 1949;

Having regard to the Agreement

between the Parties to the North Atlantic Treaty regarding the

status of their Forces (NATO SOFA), signed in London on

19th June, 1951;

Considering the Treaty on the

European Union as amended by the Treaty of Nice, signed on

26th February, 2001;

Contributing to the development of

the European security and defence identity and strengthening the

common European security and defence policy;

Willing to intensify their good

and cordial relations,

Desiring to complement and

reinforce cooperation on subjects of common interest,

Have reached the following

understanding:

Section 1

OBJECTIVES OF COOPERATION

1.1. This Memorandum of

Understanding concerning defence and military relations

(hereinafter referred to as "the MoU") establishes the framework

for cooperation in defence and military matters between the

Participants in areas of mutual interest.

1.2. Participants recognize that

enhanced relations and cooperation in defence and military

matters offer an opportunity for each side to increase mutual

understanding.

1.3. Participants recognize that

good relations and cooperation lead to a better interoperability,

which can lead to working side by side during international

missions.

Section 2

SCOPE AND FORMS OF COOPERATION

2.1. Cooperation will be carried

out in the English language and may include, among others, the

following topics:

• security and defence policy;

• issues related to humanitarian,

peacekeeping and crisis management operations;

• military education, training and

exercises;

• organizational and procedural

aspects of the functioning of the Ministries of Defence and the

Armed Forces;

• army-society relations and

public affairs;

• legal issues;

• defence material;

• environmental issues;

• other areas upon mutual consent

of the Participants.

2.2. The forms of the cooperation

can be as follows:

• visits and working meetings;

• consultations, exchange of

experience;

• training, exercises, workshops,

meetings and seminars;

• exchange of information,

material or personnel;

• cultural activities;

• other activities upon

agreement.

2.3. The execution of specific

programmes can be subject of and detailed in separate

implementing arrangements.

Section 3

PLANNING

Participants may together prepare

an annual detailed plan for cooperation.

This plan will then be agreed upon

by the Directors of International Cooperation or their

representatives at the beginning of the year for which it was

made.

Section 4

FINANCIAL ASPECTS

Unless otherwise decided by the

Participants, each Participant will bear its own costs in

relation to the implementation of the MoU.

Section 5

SECURITY OF INFORMATION

Classified information generated

or exchanged as a result of the execution of this MoU will be

treated in accordance with the provisions as set forth in the

NATO document C-M (2002)49 and its subsequent amendments as well

as relevant bilateral and international arrangements.

Section 6

DISPUTES

Any dispute arising from the

interpretation or implementation of this MoU will be resolved

amicably through direct consultation between the Participants and

will not be referred to a national or international tribunal or

any other third party for settlement.

Section 7

FINAL PROVISIONS

7.1. This MoU, which does not

create any rights or obligations under international law, will

come into effect on the date of the last signature thereto. It

will remain in effect for an unlimited period of time, unless

either Participant notifies the other six months in advance of

its intention to terminate the MoU.

7.2. Notwithstanding the

termination of this MOU, the provisions of Section 5 (Security of

information) will remain in effect and the provisions of Section

4 (Financial aspects) and Section 6 (Disputes) will remain in

effect until all outstanding payments and claims are settled.

7.3. On the date of entry into

effect of this MoU, the Protocol of Intent between the Minister

of Defence of the Republic of Latvia and the Minister of Defence

of the Kingdom of the Netherlands on bilateral contacts and

co-operation in the defence matters, signed on April

27th, 1998 will be terminated.

7.4. The contents of this MoU may

be reviewed at any time, and may be amended by mutual written

consent of the Participants.

ņemot vērā 1951.gada 19.jūnijā

Londonā parakstīto Ziemeļatlantijas līguma organizācijas

dalībvalstu līgumu par to bruņoto spēku statusu (NATO SOFA);

ņemot vērā ar 2001.gada

26.februārī Nīcas līgumu grozīto Līgumu par Eiropas

Savienību;

veicinot Eiropas drošības un

aizsardzības identitātes attīstību un stiprinot kopējo Eiropas

drošības un aizsardzības politiku;

vēloties pastiprināt savas labās

un sirsnīgās attiecības,

cenšoties padziļināt un

pastiprināt sadarbību kopīgu interešu jomās,

ir vienojušies šādi:
