1Definīcijas
21. Šajā Nolīgumā, ja kontekstā nav paredzēts citādi:
3a) termins "Konvencija" nozīmē Konvenciju par
4starptautisko civilo aviāciju, kas atklāta parakstīšanai Čikāgā
51944.gada 7.decembrī, un visus tās pielikumus, kas pieņemti
6saskaņā ar šīs Konvencijas 90.pantu, kā arī pielikumu vai
7Konvencijas grozījumus, kas izdarīti saskaņā ar šīs Konvencijas
890. un 94.pantu, ciktāl šie pielikumi un grozījumi kļuvuši
9saistoši abām Līgumslēdzējām Pusēm vai tās šos pielikumus un
10grozījumus ratificējušas;
11b) termins "aviācijas institūcijas" attiecībā
12uz Latvijas Republiku nozīmē Satiksmes ministriju un attiecībā uz
13Armēnijas Republiku, Civilās aviācijas galveno departamentu
14Armēnijas Republikas valdībā, vai abos gadījumos - jebkuru
15personu vai institūciju, kas ir pilnvarota veikt minēto aviācijas
16institūciju funkcijas;
17c) termins "nozīmētā aviokompānija" nozīmē
18aviokompāniju, kura ir nozīmēta un pilnvarota saskaņā ar šā
19Nolīguma 4.pantu;
20d) terminam "teritorija" attiecībā uz
21Līgumslēdzējām Pusēm ir Konvencijas 2. pantā noteiktā nozīme;
22e) terminiem "gaisa satiksme",
23"starptautiskā gaisa satiksme",
24"aviokompānija" un "apstāšanās
25nekomerciālos nolūkos" ir Konvencijas 96.pantā noteiktā
26nozīme;
27f) termins "tarifs" nozīmē cenu, kas tiek
28noteikta par pasažieru, bagāžas vai kravas (izņemot pastu)
29pārvadāšanu, ieskaitot jebkurus nozīmīgus papildu labumus, kas
30tiek sniegti vai kuri ir pieejami saistībā ar šiem pārvadājumiem,
31un komisijas naudu, kura tiek maksāta par personu pārvadāšanas
32biļešu pārdošanu, vai par attiecīgiem darījumiem, kas saistīti ar
33kravu pārvadāšanu. Tas ietver arī apstākļus, kuri nosaka maksas
34par pārvadāšanu vai komisijas naudas piemērošanu.
35g) termins "pielikums" nozīmē šā Nolīguma
36pielikumu vai tā grozījumus, kas izdarīti saskaņā ar šā Nolīguma
3720.panta nosacījumiem. Pielikums veido šā Nolīguma neatņemamu
38sastāvdaļu un, ja nav paredzēts citādi, visas atsauces uz šo
39Nolīgumu ietver sevī atsauces arī uz pielikumu.
402. Šā Nolīguma izpratnē atsauces uz Latvijas Republikas
41pilsoņiem nozīmē atsauces uz Eiropas Kopienas dalībvalstu
42pilsoņiem. Šā Nolīguma izpratnē atsauces uz Latvijas Republikas
43aviokompāniju vai aviokompānijām nozīmē atsauces uz Latvijas
44Republikas nozīmētu aviokompāniju vai aviokompānijām.
1Pārvadājumu tiesību piešķiršana
21. Lai veiktu starptautisko gaisa satiksmi, katra
3Līgumslēdzēja Puse piešķir otrai Līgumslēdzējai Pusei šādas
4tiesības:
5a) tiesības bez apstāšanās lidot pāri savas valsts
6teritorijai;
7b) tiesības apstāties minētajā teritorijā nekomerciālos
8nolūkos.
92. Katra Līgumslēdzēja Puse piešķir otrai Līgumslēdzējai Pusei
10šajā Nolīgumā paredzētās tiesības veikt starptautisko gaisa
11satiksmi maršrutos, kas noteikti šā Nolīguma pielikumā. Šāda
12satiksme un maršruti turpmāk attiecīgi tiek dēvēti par
13"Nolīgumā paredzēto satiksmi" un
14"noteiktajiem maršrutiem". Veicot Nolīgumā
15paredzēto satiksmi noteiktajā maršrutā, papildus šā panta
161.punktā minētajām tiesībām katras Līgumslēdzējas Puses
17nozīmētajai aviokompānijai vai aviokompānijām otra Līgumslēdzēja
18Puse piešķir tiesības apstāties savas valsts teritorijā maršruta
19punktos, kas noteikti pielikumā, lai, pamatojoties uz
20komerciāliem nosacījumiem, kombinēti vai atsevišķi uzņemtu un
21(vai) izsēdinātu starptautiskās satiksmes pasažierus, iekrautu un
22(vai) izkrautu bagāžu, kravu un pastu.
233. Nekas šā panta 2.punktā nevar tikt iztulkots kā vienas
24Līgumslēdzējas Puses nozīmētās aviokompānijas tiesības uzņemt
25otras Līgumslēdzējas Puses valsts teritorijā pasažierus, kravu un
26pastu, lai tos par atlīdzību vai uz nomas līguma pamata nogādātu
27uz citu punktu šīs otras Līgumslēdzējas Puses valsts teritorijā
28(kabotāža).
294. Ja bruņota konflikta, politisko nemieru vai notikumu, vai
30citu īpašu un neparastu apstākļu dēļ vienas Līgumslēdzējas Puses
31nozīmētā aviokompānija nav spējīga veikt lidojumus savā parastajā
32maršrutā, tad otra Līgumslēdzēja Puse pieliek visas pūles, lai
33sekmētu šādas gaisa satiksmes nepārtrauktību, attiecīgi īslaicīgi
34pārkārtojot maršrutus.
1Apliecību un licenču atzīšana
21. Lidojumu drošības apliecības, kvalifikācijas apliecības un
3licences, kuras izsniegusi vai par derīgām atzinusi viena
4Līgumslēdzēja Puse, to derīguma termiņa ietvaros par derīgām
5atzīst arī otra Līgumslēdzēja Puse, ja prasības, saskaņā ar kurām
6šīs apliecības vai licences izsniegtas vai atzītas par derīgām,
7atbilst Konvencijas noteiktajiem minimālajiem standartiem vai ir
8augstākas par tiem.
92. Katra Līgumslēdzēja Puse saglabā tiesības atteikties atzīt
10par derīgām kvalifikācijas apliecības un licences, kuras tās
11pilsoņiem lidojumiem virs tās teritorijas izsniegusi vai atzinusi
12par derīgām otra Līgumslēdzēja Puse vai jebkura cita valsts.
1Aviokompāniju nozīmēšana un pārvadājumu atļaujas izsniegšana
21. Lai veiktu šajā Nolīgumā paredzēto satiksmi noteiktajos
3maršrutos, katrai Līgumslēdzējai Pusei ir tiesības rakstiski
4nozīmēt otrai Līgumslēdzējai Pusei vienu vai vairākas
5aviokompānijas.
62. Katrai Līgumslēdzējai Pusei ir tiesības atsaukt vai grozīt
7šo nozīmējumu, par to rakstiski paziņojot otrai Līgumslēdzējai
8Pusei.
93. Šādu nozīmējumu saņemot, otra Līgumslēdzēja Puse piešķir
10attiecīgas pilnvaras un atļaujas, ievērojot vismazāko kavēšanās
11laiku procedūras dēļ, ar šādiem nosacījumiem:
12a) Gadījumā, kad aviokompāniju nozīmē Latvijas Republikas
13puse:
14i) tā ir reģistrēta Latvijas Republikas teritorijā saskaņā ar
15Eiropas Kopienas dibināšanas līgumu un tai ir derīga licence par
16tiesībām veikt gaisa pārvadājumus saskaņā ar Eiropas Kopienas
17tiesību aktiem; un
18ii) aviokompānijas faktisko regulējošo kontroli veic un uztur
19Eiropas Kopienas dalībvalsts, kas atbild par ekspluatanta
20sertifikāta izsniegšanu, un nozīmējumā ir skaidri norādīta
21attiecīgā aviācijas institūcija.
22b) Gadījumā, kad aviokompāniju nozīmē Armēnijas Republikas
23puse:
24i) tā ir reģistrēta Armēnijas Republikas teritorijā un tā ir
25licencēta saskaņā ar Armēnijas Republikas tiesību aktiem; un
26ii) aviokompānijas faktisko regulējošo kontroli veic un uztur
27Armēnijas Republika, kas atbild par ekspluatanta sertifikāta
28izsniegšanu, un nozīmējumā ir skaidri norādīta attiecīgā
29aviācijas institūcija.
30c) Vienas Līgumslēdzējas Puses aviācijas institūcijas ir
31tiesīgas pieprasīt, lai otras Līgumslēdzējas Puses nozīmētā
32aviokompānija pierāda, ka tā spēj pildīt normatīvos aktus, kurus
33saskaņā ar Konvencijas prasībām šīs institūcijas parasti un
34pieņemami piemēro starptautiskajiem gaisa pārvadājumiem.
354. Pēc nozīmēšanas un pilnvarošanas aviokompānija, ja tā ir
36izpildījusi visus šā Nolīguma noteikumus, ieskaitot noteikumus
37attiecībā uz tarifiem, jebkurā laikā drīkst uzsākt šajā Nolīgumā
38paredzēto satiksmi.
1Pārvadājumu atļaujas izsniegšanas atteikums, atcelšana vai
2apturēšana
31. Ikviena Līgumslēdzēja Puse var atsaukt, apturēt vai
4ierobežot otras Līgumslēdzējas Puses nozīmētās aviokompānijas
5pārvadājumu atļauju vai tehniskās atļaujas, ja:
6a) gadījumā, kad aviokompāniju nozīmē Latvijas Republikas
7puse:
8i) tā nav reģistrēta Latvijas Republikas teritorijā saskaņā ar
9Eiropas Kopienas dibināšanas līgumu vai tai nav derīgas licences
10par tiesībām veikt gaisa pārvadājumus saskaņā ar Eiropas Kopienas
11tiesību aktiem; vai
12ii) aviokompānijas faktisko regulējošo kontroli neveic vai
13neuztur Eiropas Kopienas dalībvalsts, kas atbild par ekspluatanta
14sertifikāta izsniegšanu, vai nozīmējumā nav skaidri norādīta
15attiecīgā aviācijas institūcija.
16b) Gadījumā, kad aviokompāniju nozīmē Armēnijas Republikas
17puse:
18i) tā nav reģistrēta Armēnijas Republikas teritorijā vai nav
19licencēta saskaņā ar Armēnijas Republikas tiesību aktiem; vai
20ii) aviokompānijas faktisko regulējošo kontroli neveic un
21neuztur Armēnijas Republika, kas atbild par ekspluatanta
22sertifikāta izsniegšanu, vai nozīmējumā nav skaidri norādīta
23attiecīgā aviācijas institūcija.
24c) ja šī aviokompānija nespēj izpildīt Līgumslēdzējas Puses,
25kas piešķīrusi šīs tiesības, normatīvos aktus, vai
26d) ja aviokompānija jebkādā citā veidā nespēj veikt Nolīgumā
27paredzēto satiksmi saskaņā ar šajā Nolīgumā paredzētajiem
28noteikumiem,
29e) ja otra Līgumslēdzēja Puse nespēj izpildīt vai piemērot
30aviācijas drošības un lidojumu drošības standartus saskaņā ar šā
31Nolīguma 15. un 16.pantu.
322. Ja nav nepieciešama šā panta 1.punktā minētā tūlītēja
33atļaujas atcelšana, apturēšana vai saistību izpildes
34pieprasīšana, lai novērstu turpmāku normatīvo aktu un (vai)
35noteikumu pārkāpšanu, šīs tiesības izmanto tikai pēc
36konsultācijām ar otras Līgumslēdzējas Puses aviācijas
37institūcijām. Šīs konsultācijas sākas trīsdesmit (30) dienu laikā
38pēc tam, kad saņemts pieprasījums pēc konsultācijām.
1Nediskriminējoši maksājumi
21. Maksājumi, kurus par lidostu un citu aviācijas iekārtu
3izmantošanu vienas Līgumslēdzējas Puses valsts teritorijā uzliek
4otras Līgumslēdzējas Puses jebkuras nozīmētās aviokompānijas
5gaisa kuģim, nav augstāki par maksājumiem, kurus uzliek savas
6valsts gaisa kuģim, kas veic līdzīgu starptautisko gaisa
7satiksmi.
82. Maksājumi par lidostu vai jebkuru citu aviācijas
9pakalpojumu un iekārtu izmantošanu, kā arī jebkura cita maksa,
10kas tiek uzlikta sakarā ar starptautiskās gaisa satiksmes
11veikšanu, tiek noteikta pamatojoties uz izmaksām, par kurām katra
12Līgumslēdzēja Puse var pieprasīt atbilstošus pierādījumus. Tas
13attiecas arī uz pasažieru, bagāžas un kravas apkalpošanu, kā arī
14uz gaisa kuģu apkalpošanu lidostās, kurās ir tikai viens minēto
15pakalpojumu sniedzējs.
163. Maksājumus nosaka un tos maksā vietējā valūtā.
1Atbrīvošana no muitas un citiem nodokļiem
21. Vienas Līgumslēdzējas Puses nozīmētās aviokompānijas gaisa
3kuģis, kas veic starptautisko gaisa satiksmi, kā arī tā parastais
4aprīkojums, rezerves daļas, degvielas un smērvielu krājumi, gaisa
5kuģa krājumi (ieskaitot ēdienus, dzērienus un tabakas
6izstrādājumus), kas atrodas šajā gaisa kuģī, tam ierodoties otras
7Līgumslēdzējas Puses valsts teritorijā, tiek atbrīvoti no visiem
8muitas nodokļiem, pārbaudes maksājumiem un citiem līdzīgiem
9maksājumiem, ja šis aprīkojums, rezerves daļas un krājumi paliek
10gaisa kuģī līdz to izvešanai vai izmantošanai šajā gaisa kuģī,
11lidojot pāri minētajai teritorijai.
122. No šā panta l. punktā minētajiem nodokļiem un maksājumiem,
13izņemot maksu par sniegtajiem pakalpojumiem, atbrīvo arī:
14a) gaisa kuģa krājumus, kas pieņemamā daudzumā uzņemti gaisa
15kuģī vienas Līgumslēdzējas Puses valsts teritorijā izmantošanai
16izlidojošā otras Līgumslēdzējas Puses nozīmētās aviokompānijas
17starptautiskās satiksmes gaisa kuģī;
18b) rezerves daļas, ieskaitot dzinējus, kas ievesti vienas
19Līgumslēdzējas Puses valsts teritorijā, lai veiktu otras
20Līgumslēdzējas Puses nozīmētās aviokompānijas starptautiskās
21satiksmes gaisa kuģa tehnisko apkopi vai remontu;
22c) degvielu, smērvielas un nepieciešamos tehniskos krājumus,
23kas ievesti vai piegādāti vienas Līgumslēdzējas Puses valsts
24teritorijā, lai tos izmantotu otras Līgumslēdzējas Puses
25starptautiskās satiksmes gaisa kuģī, pat ja šie krājumi tiek
26izmantoti, lidojot virs tās Līgumslēdzējas Puses valsts
27teritorijas, kurā tie uzņemti gaisa kuģī.
283. Šā panta 2. punktā minētos materiālus var pieprasīt
29uzglabāt muitas uzraudzībā vai kontrolē.
304. Parastais gaisa kuģa aprīkojums, kā arī materiāli, krājumi
31un rezerves daļas, kuras parasti paliek vienas Līgumslēdzējas
32Puses nozīmētās aviokompānijas gaisa kuģī, var tikt izkrautas
33otras Līgumslēdzējas Puses valsts teritorijā vienīgi ar šīs
34Līgumslēdzējas Puses muitas institūciju piekrišanu. Šajā gadījumā
35tās var novietot minēto institūciju uzraudzībā uz laiku, kamēr
36tās tiek izvestas vai citādi izvietotas saskaņā ar muitas
37noteikumiem.
385. Gaisa kuģim nepieciešamie dokumenti, piemēram, lidojumu
39saraksti, biļetes un pavadzīmes, kuras paredzējusi izmantot
40vienas Līgumslēdzējas Puses nozīmētā aviokompānija un kuras tiek
41ievestas otras Līgumslēdzējas Puses valsts teritorijā, šajā
42teritorijā tiek atbrīvotas no muitas nodokļiem un citiem
43līdzīgiem maksājumiem.
446. Bagāža un krava, kas tiešajā tranzītā šķērso Līgumslēdzējas
45Puses valsts teritoriju, tiek atbrīvota no muitas nodokļiem un
46citiem līdzīgiem maksājumiem, izņemot maksu par pakalpojumiem,
47kas tiek sniegti, ierodoties šajā teritorijā vai to atstājot.
487. Nekas šā Nolīguma nosacījumos neliedz Latvijas Republikai
49bez diskriminācijas ieviest nodokļus, nodevas, maksājumus vai
50maksu par degvielu, ko tās teritorijā piegādā izmantošanai
51Armēnijas Republikas nozīmētās aviokompānijas gaisa kuģī, kas
52darbojas maršrutā starp kādu punktu Latvijas Republikas
53teritorijā un citu punktu Latvijas Republikas teritorijā vai
54citas Eiropas Kopienas dalībvalsts teritorijā.
1Kapacitātes noteikumi
21. Abu Līgumslēdzēju Pušu nozīmētajām aviokompānijām ir
3taisnīgas un vienlīdzīgas iespējas veikt šajā Nolīgumā paredzēto
4gaisa satiksmi noteiktajos maršrutos.
52. Veicot šajā Nolīgumā paredzēto satiksmi, katras
6Līgumslēdzējas Puses nozīmētās aviokompānijas ievēro otras
7Līgumslēdzējas Puses nozīmēto aviokompāniju intereses, lai
8nenodarītu kaitējumu satiksmei, kuru tās veic tajos pašos
9maršrutos vai jebkurā šo maršrutu daļā.
103. Veicot šajā Nolīgumā paredzēto satiksmi, Līgumslēdzēju Pušu
11nozīmēto aviokompāniju galvenais mērķis ir, ievērojot saprātīgu
12gaisa kuģa noslodzes faktoru, nodrošināt kapacitāti, kas atbilstu
13esošajam un saprātīgi paredzamajam pieprasījumam pēc pasažieru,
14kravas un pasta pārvadājumiem uz aviokompāniju nozīmējušās
15Līgumslēdzējas Puses valsts teritoriju vai no tās.
164. Par pasažieru, kravas un pasta pārvadāšanu, ja šie
17pasažieri tiek uzņemti gaisa kuģī vai izsēdināti no tā un krava
18un pasts iekrauti gaisa kuģī vai izkrauti no tā punktos
19maršrutos, kuri tiks noteikti to valstu teritorijās, kuras nav
20aviokompāniju nozīmējušās valstis, tiek panākta vienošanās starp
21abām Līgumslēdzējām Pusēm.
225. Par nodrošināmo kapacitāti, ieskaitot pakalpojumu biežumu
23un Līgumslēdzēju Pušu nozīmēto aviokompāniju šajā Nolīgumā
24paredzētās gaisa satiksmes veikšanai izmantojamo gaisa kuģa tipu,
25tiek panākta vienošanās starp aviācijas institūcijām.
266. Ja Līgumslēdzējas Puses nevar panākt vienošanos, tad
275.punktā minētais jautājums tiek risināts saskaņā ar šā Nolīguma
2817. un 18.panta nosacījumiem. Kamēr nav panākta vienošanās,
29kapacitāte, kādu nodrošina nozīmētās aviokompānijas, paliek
30nemainīga.
1Satiksmes programmu apstiprināšana
21. Vienas Līgumslēdzējas Puses nozīmētā aviokompānija vai
3aviokompānijas savas satiksmes programmas (vasaras un ziemas
4periodu satiksmei) iesniedz apstiprināšanai otras Līgumslēdzējas
5Puses aviācijas institūcijām vismaz trīsdesmit (30) dienas pirms
6pārvadājumu uzsākšanas. Programmā ietver lidojumu sarakstus,
7nosaka satiksmes biežumu un izmantojamo gaisa kuģu tipus.
8Aviācijas institūcijas savu lēmumu par šo iesniegto satiksmes
9programmu paziņo divdesmit (20) dienu laikā pēc dienas, kad
10attiecīgā aviokompānija iesniegusi savu programmu
11apstiprināšanai.
122. Visus satiksmes programmas grozījumus, kā arī lūgumus
13atļaut veikt papildu lidojumus vienas Līgumslēdzējas Puses
14nozīmētā aviokompānija vai aviokompānijas iesniedz
15apstiprināšanai otras Līgumslēdzējas Puses aviācijas
16institūcijām. Minētās aviācijas institūcijas šos lūgumus par
17grozījumiem vai papildu lidojumiem izskata nekavējoties.
1Informācija un statistika
2Katras Līgumslēdzējas Puses aviācijas institūcijas pēc otras
3Līgumslēdzējas Puses aviācijas institūciju pieprasījuma iesniedz
4tām tādu informāciju un statistikas datus par savas nozīmētās
5aviokompānijas vai aviokompāniju veikto satiksmi uz otras
6Līgumslēdzējas Puses valsts teritoriju un no tās, kādus tām
7parasti sagatavo un iesniedz attiecīgās valsts aviokompānijas. Ja
8vienas Līgumslēdzējas Puses aviācijas institūcijas vēlas saņemt
9jebkādus papildu statistikas datus, pēc to pieprasījuma abu
10Līgumslēdzēju Pušu aviācijas institūcijas šo jautājumu apspriež
11savstarpējās sarunās un par to vienojas.
1Tarifi
21. Tarifus, kurus nosaka nozīmētā aviokompānija par pasažieru
3pārvadāšanu maršrutos, kas noteikti saskaņā ar šā Nolīguma
42.panta 2.punktu, apstiprina Līgumslēdzējas Puses, kuras
5teritorijā atrodas lidojuma sākumpunkts (saskaņā ar pārvadājumu
6dokumentācijā norādīto informāciju), aviācijas institūcijas.
72. Nosakot tarifus, nozīmētās aviokompānijas ņem vērā
8pārvadājumu izmaksas, pieņemamu peļņu, konkurences un tirgus
9dominējošos apstākļus, kā arī lietotāju intereses. Kompetentās
10aviācijas institūcijas var atteikties apstiprināt tarifu tikai
11tad, ja tas neatbilst šiem kritērijiem.
123. Nozīmētās aviokompānijas iesniedz tarifus apstiprināšanai
13aviācijas institūcijām vismaz trīsdesmit (30) dienas pirms
14paredzētās šo tarifu ieviešanas dienas.
154. Ja kādas Līgumslēdzējas Puses aviācijas institūcijas
16nepiekrīt tarifam, kas iesniegts to apstiprināšanai, tās informē
17attiecīgo aviokompāniju divdesmit (20) dienu laikā pēc tarifa
18iesniegšanas. Šādā gadījumā jauno tarifu nepiemēro. Turpina
19piemērot to tarifu, kurš tika piemērots līdz jaunā tarifa
20iesniegšanai.
215. Neskatoties uz šajā pantā noteikto, tarifi, kas jāmaksā
22Armēnijas Republikas nozīmētajai aviokompānijai vai
23aviokompānijām par pārvadāšanu tikai Eiropas Kopienā, tiek
24aprēķināti, pamatojoties uz Eiropas Kopienas tiesību aktiem.
1Taisnīga konkurence
21. Abu Līgumslēdzēju Pušu nozīmētajām aviokompānijam ir
3taisnīgas un vienlīdzīgas iespējas veikt šajā Nolīgumā paredzēto
4starptautisko gaisa satiksmi.
52. Nepieciešamības gadījumā katra Līgumslēdzēja Puse veic
6visus attiecīgos tās jurisdikcijā esošos pasākumus, lai novērstu
7visu veidu diskrimināciju vai negodīgu konkurenci, kas
8nelabvēlīgi ietekmē otras Līgumslēdzējas Puses aviokompāniju
9konkurētspēju.
1Komercdarbība
21. Katras Līgumslēdzējas Puses nozīmētajai aviokompānijai vai
3aviokompānijām ir tiesības otras Līgumslēdzējas Puses valsts
4teritorijā saskaņā ar tās normatīvajiem aktiem uzturēt birojus un
5administratīvo, komerciālo un tehnisko personālu, kas
6nepieciešams attiecīgās nozīmētās aviokompānijas prasībām.
72. Šā panta 1.punktā minētās katras Līgumslēdzējas Puses
8nozīmēto aviokompāniju tiesības otras Līgumslēdzējas Puses valsts
9teritorijā izveidot birojus un nodarbināt personālu tiek
10izmantotas saskaņā ar šīs otras Līgumslēdzējas Puses valsts
11normatīvajiem aktiem, tajā skaitā tiem normatīvajiem aktiem, kas
12regulē ārvalstnieku ierašanos šīs Līgumslēdzējas Puses valsts
13teritorijā un uzturēšanos tajā. Personālam, kas saskaņā ar šā
14panta 1.punktu tiek nodarbināts birojos, pēc pieprasījuma un
15neņemot vērā situāciju darba tirgū un šā tirgus attīstību, tiek
16izsniegtas darba atļaujas.
173. Līgumslēdzēju Pušu nozīmētajām aviokompānijām ir tiesības,
18izmantojot savus transporta dokumentus, abu Līgumslēdzēju Pušu
19valstu teritorijās tieši vai ar aģentu starpniecību par
20attiecīgās Līgumslēdzējas Puses valsts valūtu pārdot gaisa
21satiksmes pakalpojumus. Katra Līgumslēdzēja Puse neierobežo otras
22Līgumslēdzējas Puses nozīmētās aviokompānijas vai aviokompāniju
23tiesības pārdot gaisa satiksmes pakalpojumus un jebkuras personas
24tiesības tos pirkt.
1Aviācijas drošība
21. Saskaņā ar tiesībām un pienākumiem, kas izriet no
3starptautisko tiesību normām, Līgumslēdzējas Puses apliecina, ka
4šā Nolīguma neatņemama sastāvdaļa ir to savstarpējais pienākums
5aizsargāt civilās aviācijas drošību pret nelikumīgas iejaukšanās
6aktiem. Neierobežojot starptautisko tiesību normu un no tām
7izrietošo tiesību un pienākumu vispārējo raksturu, Līgumslēdzējas
8Puses darbojas saskaņā ar Konvenciju par noziegumiem un dažām
9citām nelikumīgām darbībām, kas izdarītas gaisa kuģos, kura
10parakstīta 1963. gada 14. septembrī Tokijā, Konvenciju par cīņu
11pret nelikumīgu gaisa kuģu sagrābšanu, kura parakstīta 1970. gada
1216. decembrī Hāgā un Konvenciju par cīņu pret nelikumīgām
13darbībām, kas apdraud civilās aviācijas drošību, kura parakstīta
141971. gada 23. septembrī Monreālā un Protokolu par cīņu pret
15nelikumīgu vardarbību lidostās, kas apkalpo starptautisko civilo
16aviāciju, kas parakstīts 1988.gada 24.februārī Monreālā vai
17jebkuru citu aviācijas drošības konvenciju, kuru abas
18Līgumslēdzējas Puses apņemsies ievērot.
192. Katra Līgumslēdzēja Puse pēc otras Līgumslēdzējas Puses
20lūguma sniedz tai visu nepieciešamo palīdzību, lai novērstu
21nelikumīgu civilās aviācijas gaisa kuģu sagrābšanu un citas pret
22gaisa kuģiem, to pasažieriem un apkalpēm, lidostām un
23aeronavigācijas iekārtām vērstas nelikumīgas darbības un jebkurus
24citus draudus civilās aviācijas drošībai.
253. Līgumslēdzējas Puses savstarpējās attiecībās rīkojas
26saskaņā ar aviācijas drošības noteikumiem un tehniskajām
27prasībām, kuras noteikusi Starptautiskā civilās aviācijas
28organizācija un kuras kā pielikumi pievienotas Konvencijai,
29ciktāl šie drošības noteikumi un prasības ir piemērojamas
30Līgumslēdzējām Pusēm; tās pieprasa, lai visi to reģistrā
31reģistrēto gaisa kuģu ekspluatanti vai gaisa kuģu ekspluatanti,
32kuru galvenā darbības vieta vai pastāvīgā uzturēšanās vieta ir to
33teritorijā, darbotos saskaņā ar minētajiem aviācijas drošības
34noteikumiem.
354. Katra Līgumslēdzēja Puse piekrīt, ka minētajiem gaisa kuģu
36ekspluatantiem var pieprasīt ievērot šā panta 3. punktā
37paredzētos aviācijas drošības noteikumus un prasības, ko pieprasa
38ievērot viena Līgumslēdzēja Puse, tās valsts teritorijā
39ierodoties otras Līgumslēdzējas Puses gaisa kuģiem, tiem atstājot
40šo teritoriju vai uzturoties tajā. Piemērojamo likumu ietvaros
41katra Līgumslēdzēja Puse nodrošina, lai tās valsts teritorijā
42tiktu veikti atbilstoši pasākumi gaisa kuģu aizsardzībai un
43pasažieru, apkalpes, pasažieriem klātesošās bagāžas, bagāžas,
44kravas un gaisa kuģa krājumu pārbaudei pirms iekāpšanas vai
45iekraušanas gaisa kuģī vai tās laikā. Katra Līgumslēdzēja Puse ar
46sapratni izvērtē jebkuru otras Līgumslēdzējas Puses lūgumu pēc
47saprātīgiem drošības pasākumiem, lai novērstu īpašus draudus.
485. Nelikumīga gaisa kuģa sagrābšanas incidenta vai tā draudu
49gadījumā, kā arī tad, ja tiek veiktas citas nelikumīgas pret
50gaisa kuģa, tā pasažieru un apkalpes, lidostu vai aeronavigācijas
51iekārtu drošību vērstas darbības, Līgumslēdzējas Puses viena
52otrai sniedz palīdzību, atvieglojot sakaru līdzekļu izmantošanu
53un veicot citus nepieciešamos pasākumus, lai ātri un droši
54izbeigtu šo incidentu vai novērstu tā draudus.
556. Ja viena Līgumslēdzēja Puse pārkāpj šajā pantā noteiktās
56aviācijas drošības prasības, otras Līgumslēdzējas Puses aviācijas
57institūcijas var pieprasīt tūlītējas konsultācijas ar šīs
58Līgumslēdzējas Puses aviācijas institūcijām. Ja viena mēneša
59laikā pēc konsultāciju pieprasīšanas netiek panākta pieņemama
60vienošanās, minētās Līgumslēdzējas Puses nozīmētās aviokompānijas
61vai aviokompāniju pārvadājumu atļaujas var tikt apturētas,
62atceltas, ierobežotas vai arī var tikt pieprasīta noteiktu
63nosacījumu izpilde. Īpašas nepieciešamības gadījumā katra
64Līgumslēdzēja Puse var veikt pagaidu darbības pirms viena mēneša
65termiņa beigām.
1Lidojumu drošība
21. Katra Līgumslēdzēja Puse jebkurā laikā var pieprasīt
3konsultācijas par otras Līgumslēdzējas Puses pieņemtajiem
4lidojumu drošības standartiem visās jomās, kas attiecas uz
5apkalpi, gaisa kuģi vai tā izmantošanu. Šīs konsultācijas sākas
6trīsdesmit (30) dienu laikā pēc pieprasījuma iesniegšanas.
72. Ja pēc minētajām konsultācijām viena Līgumslēdzēja Puse
8konstatē, ka otra Līgumslēdzēja Puse kādā no jomām neefektīvi
9ievēro un nepilda spēkā esošos lidojumu drošības standartus, kas
10izstrādāti atbilstoši vismaz minimālajiem Konvencijā noteiktajiem
11standartiem, tā paziņo otrai Līgumslēdzējai Pusei par iegūto
12informāciju un pasākumiem, kas jāveic, lai nodrošinātu atbilstību
13šiem minimālajiem standartiem, un šī otra Līgumslēdzēja Puse veic
14nepieciešamos pasākumus. Ja pēc minētā paziņojuma saņemšanas otra
15Līgumslēdzēja Puse neveic nepieciešamos pasākumus piecpadsmit
16(15) dienu laikā vai ilgākā laika periodā, ja par to panākta
17vienošanās, tiek piemēroti šā Nolīguma 5.panta noteikumi.
183. Neskatoties uz Konvencijas 33.pantā noteiktajiem
19pienākumiem, katru vienas Līgumslēdzējas Puses nozīmētās
20aviokompānijas vai aviokompāniju gaisa kuģi, ar kuru tiek veikta
21satiksme uz otras Līgumslēdzējas Puses valsts teritoriju vai no
22tās, laikā, kad tas atrodas šīs otras Līgumslēdzējas Puses valsts
23teritorijā, no iekšpuses un ārpuses var pārbaudīt tās pilnvaroti
24pārstāvji, lai konstatētu gaisa kuģa un tā apkalpes dokumentu
25derīgumu un saskatāmo gaisa kuģa un tā aprīkojuma stāvokli (šajā
26pantā - "gaisa kuģa pārbaude"), ja vien šī pārbaude neizraisa
27nepamatotu aizkavēšanos.
284. Ja gaisa kuģa pārbaudes vai pārbaužu sērijas rezultātā
29rodas:
30a) pamatotas aizdomas, ka gaisa kuģis vai šā gaisa kuģa
31izmantošana neatbilst attiecīgajā laika posmā Konvencijā
32noteiktajiem un spēkā esošajiem minimālajiem standartiem, vai
33b) pamatotas aizdomas, ka nepieciešama efektīva apkope un
34Konvencijā noteikto un spēkā esošo lidojumu drošības standartu
35izpilde,
36Līgumslēdzēja Puse, kas veikusi pārbaudi, atbilstoši
37Konvencijas 33.panta noteikumiem var secināt, ka prasības,
38saskaņā ar kurām apliecība un licences par gaisa kuģi vai tā
39apkalpi izsniegtas vai atzītas par derīgām, vai prasības, saskaņā
40ar kurām gaisa kuģis veic lidojumus, neatbilst vai ir zemākas par
41Konvencijā noteiktajiem un spēkā esošajiem minimālajiem
42standartiem.
435. Ja vienas Līgumslēdzējas Puses nozīmētās aviokompānijas vai
44aviokompāniju pārstāvis aizliedz piekļūt gaisa kuģim, kuru šī
45aviokompānija izmanto vai kurš tiek izmantots tās vārdā, lai
46veiktu pārbaudi saskaņā ar šā panta 3.punkta noteikumiem, otra
47Līgumslēdzēja Puse var konstatēt, ka tas izraisa nopietnas
48aizdomas par šā panta 4.punktā minētajiem pārkāpumiem, un izdarīt
49minētajā punktā noteiktos secinājumus.
506. Katra Līgumslēdzēja Puse saglabā tiesības nekavējoties
51pārtraukt vai mainīt otras Līgumslēdzējas Puses aviokompānijas
52vai aviokompāniju pārvadājumu atļaujas, ja tā pēc gaisa kuģa
53pārbaudes, gaisa kuģa pārbaužu sērijas, aizlieguma veikt gaisa
54kuģa pārbaudi, konsultācijām vai citādi konstatē, ka nekavējoties
55jāveic pasākumi, lai nodrošinātu aviokompānijas veiktās satiksmes
56drošību.
577. Katra Līgumslēdzēja Puse pārtrauc veikt pasākumus, kas
58noteikti šā panta 2. vai 6.punktā, ja ir novērsts to iemesls.
1Normatīvo aktu piemērošana
21. Vienas Līgumslēdzējas Puses normatīvos aktus, kuri regulē
3starptautiskās satiksmes gaisa kuģa ierašanos tās valsts
4teritorijā, šīs teritorijas atstāšanu vai šā gaisa kuģa
5izmantošanu un navigāciju minētajā teritorijā, piemēro otras
6Līgumslēdzējas Puses nozīmētajai aviokompānijai vai
7aviokompānijām.
82. Vienas Līgumslēdzējas Puses normatīvos aktus, kuri regulē
9pasažieru, apkalpju, kravas vai pasta ierašanos šīs valsts
10teritorijā, uzturēšanos tajā vai tās atstāšanu, piemēram,
11ieceļošanas, aizceļošanas, emigrācijas, imigrācijas, muitas,
12valūtas, veselības un karantīnas formalitātes, un kuri tiek
13piemēroti pasažieriem, apkalpēm, kravai vai pastam, ierodoties
14tās teritorijā, uzturoties tajā vai to atstājot, piemēro arī
15pasažieriem, apkalpēm, kravai un pastam, kas tiek pārvadāti otras
16Līgumslēdzējas Puses nozīmētās aviokompānijas vai aviokompāniju
17gaisa kuģos, tiem atrodoties minētajā teritorijā.
183. Pasažieri, bagāža un krava, kas tiešā tranzītā šķērso
19Līgumslēdzējas Puses valsts teritoriju un neatstāj šim nolūkam
20paredzēto lidostas teritoriju, izņemot drošības pasākumus, kas
21paredzēti vardarbības un gaisa pirātisma, kā arī narkotisko vielu
22kontrabandas novēršanai, tiek pakļauti tikai atvieglotai
23kontrolei.
244. Ja vienas Līgumslēdzējas Puses aviokompānijas atvestais
25pasažieris nepilda normatīvos aktus, kas regulē ieceļošanu otras
26Līgumslēdzējas Puses valsts teritorijā, attiecīgā aviokompānija
27par saviem līdzekļiem nogādā šādu pasažieri atpakaļ.
1Strīdu izšķiršana
21. Ja starp Līgumslēdzējām Pusēm rodas strīds par šā Nolīguma
3iztulkošanu vai piemērošanu, Līgumslēdzējas Puses vispirms to
4cenšas nokārtot tiešu divpusēju sarunu ceļā.
52. Ja Līgumslēdzējas Puses nevar strīdu nokārtot sarunu ceļā,
6tās pēc savstarpējas vienošanās var nodot strīdu izšķiršanai
7kādai personai vai institūcijai; ja tās nespēj vienoties, strīdu
8pēc vienas Līgumslēdzējas Puses pieprasījuma iesniedz izšķiršanai
9triju tiesnešu šķīrējtiesā, kurai katra Līgumslēdzēja Puse
10apstiprina vienu tiesnesi un trešo tiesnesi ieceļ šie abi jau
11apstiprinātie tiesneši. Katra Līgumslēdzēja Puse savu tiesnesi
12apstiprina sešdesmit (60) dienu laikā pēc tam, kad diplomātiskā
13ceļā ir saņēmusi otras Līgumslēdzējas Puses pieprasījumu par
14strīda izšķiršanu šķīrējtiesā, un trešais tiesnesis tiek iecelts
15sešdesmit (60) dienu laikā pēc minēto tiesnešu
16apstiprināšanas.
17Ja viena Līgumslēdzēja Puse noteiktajā laikā neapstiprina savu
18tiesnesi, Starptautiskās civilās aviācijas organizācijas Padomes
19prezidents pēc otras Līgumslēdzējas Puses pieprasījuma var iecelt
20nepieciešamo tiesnesi vai tiesnešus. Jebkurā gadījumā trešais
21tiesnesis ir trešās valsts pilsonis un veic šķīrējtiesas
22priekšsēdētāja pienākumus. Šķīrējtiesa pieņem lēmumu ar balsu
23vairākumu. Visos pārējos jautājumos šķīrējtiesa pati nosaka savas
24darbības procedūru.
253. Līgumslēdzējas Puses apņemas pildīt jebkurus lēmumus, kas
26pieņemti saskaņā ar šā panta 2. punktu.
274. Ja viena Līgumslēdzēja Puse nepilda lēmumu, kas pieņemts
28saskaņā ar šā panta 2.punktu, otra Līgumslēdzēja Puse var
29ierobežot, apturēt vai atsaukt tiesības vai priekšrocības, kas
30saskaņā ar šo Nolīgumu piešķirtas saistības nepildošajai
31Līgumslēdzējai Pusei.
325. Katra Līgumslēdzēja Puse sedz sava šķīrējtiesneša izdevumus
33un maksā viņam atlīdzību; naudas summas, kuras veido atlīdzība
34trešajam tiesnesim un ar trešā tiesneša un šķīrējtiesas darbību
35saistītie izdevumi, vienlīdzīgās daļās sedz abas Līgumslēdzējas
36Puses.
1Grozījumi
21. Ja viena Līgumslēdzēja Puse vēlas grozīt kādu šā Nolīguma
3noteikumu, tajā skaitā pielikumu, tā grozījumus var veikt pēc
4konsultācijām saskaņā ar šā nolīguma 17.pantu.
52. Šo Nolīgumu var grozīt un papildināt ar abu Līgumslēdzēju
6Pušu savstarpēju piekrišanu. Šādu grozījumu un papildinājumus var
7veikt atsevišķu protokolu veidā, kuri veido šā Nolīguma
8neatņemamu sastāvdaļu un stājas spēkā saskaņā ar šā Nolīguma
922.panta nosacījumiem.
103. Ja grozījums attiecas tikai uz šā Nolīguma pielikuma
11nosacījumiem, par to var vienoties abu Līgumslēdzēju Pušu
12aviācijas institūcijas un tas stājas spēkā no dienas, kad šīs
13aviācijas institūcijas par to ir vienojušās.
1Nolīguma izbeigšana
2Katra Līgumslēdzēja Puse jebkurā laikā var rakstveidā paziņot
3otrai Līgumslēdzējai Pusei par tās lēmumu izbeigt šo Nolīgumu. Šo
4paziņojumu vienlaikus nosūta Starptautiskajai civilās aviācijas
5organizācijai. Šis Nolīgums tiek pārtraukts pusnaktī (pēc tās
6Līgumslēdzējas Puses vietējā laika, kura ir saņēmusi paziņojumu)
7divpadsmit (12) mēnešus pēc dienas, kad otra Līgumslēdzēja Puse
8saņēmusi paziņojumu, ja vien minētais paziņojums nav atcelts ar
9vienošanos pirms šā perioda beigām. Ja otra Līgumslēdzēja Puse
10neapliecina, ka tā saņēmusi paziņojumu, šo paziņojumu uzskata par
11saņemtu četrpadsmit (14) dienas pēc tam, kad to saņēmusi
12Starptautiskā civilās aviācijas organizācija.
1Stāšanās spēkā
2Šis Nolīgums stājas spēkā dienā, kad saņemts pēdējais
3rakstiskais paziņojums, ar kuru Līgumslēdzējas Puses pa
4diplomātiskajiem kanāliem informē viena otru par nepieciešamo
5iekšējo procedūru izpildi, lai tas stātos spēkā.
6Parakstīts Erevānā 2009.gada "10" dienā decembrī divos
7oriģināleksemplāros latviešu, armēņu un angļu valodā. Visi teksti
8ir vienlīdz autentiski. Strīda gadījumā noteicošais ir teksts
9angļu valodā.

53AIR SERVICES
54AGREEMENT between the Government of the Republic of Latvia
55and the Government of the Republic of Armenia
56The Government of the Republic of Latvia and the Government of
57the Republic of Armenia, hereinafter referred to as "the
58Contracting Parties";
59Being parties to the Convention on International Civil
60Aviation opened for signature at Chicago on 7 December 1944;
61Desiring to conclude an Agreement in conformity with and
62supplementary to the said Convention for the purpose of
63establishing scheduled air services between and beyond their
64respective territories based on the principle of reciprocity,
65Have agreed as follows:
66Article 1
67Definitions
681. For the purposes of this Agreement, unless the context
69otherwise requires:
70a) the term "Convention" means the Convention
71on International Civil Aviation opened for signature at Chicago
72on 7 December 1944, and includes any Annex adopted under Article
7390 of that Convention and any amendment of the Annexes and
74Convention adopted under Articles 90 and 94 thereof so far as
75those Annexes and amendments have become effective for or have
76been ratified by both Contracting Parties;
77b) the term "aeronautical authorities" means,
78in the case of the Republic of Latvia, the Ministry of Transport,
79and in the case of the Republic of Armenia, the General
80Department of Civil Aviation at the Government of the Republic of
81Armenia, or, in both cases, any other person or body authorized
82to perform any functions at present exercised by the said
83aeronautical authorities;
84c) the term "designated airline" means an
85airline which has been designated and authorized in accordance
86with Article 4 of this Agreement;
87d) the term "territory" in relation to the
88Contracting Parties has the meaning assigned to it in Article 2
89of the Convention;
90e) the terms "air service", "international
91air service", "airline" and "stop
92for non-traffic purposes" have the meanings assigned
93to them in Article 96 of the Convention;
94f) the term "tariff" means the prices to be
95charged for the carriage of passengers, baggage or cargo
96(excluding mail), including any significant additional benefits
97to be furnished or made available in conjunction with such
98carriage, and the commission to be paid on the sales of tickets
99for the carriage of persons, or on corresponding transactions for
100the carriage of cargo. It includes also the conditions that
101govern the applicability of the price for carriage or the payment
102of commission;
103g) the term "Annex" means the Annex to this
104Agreement or as amended in accordance with the provisions of
105Article 20 of this Agreement. The Annex forms an integral part of
106this Agreement and all references to this Agreement shall
107includes also references to the Annex except where explicitly
108agreed otherwise.
1092. References in this Agreement to nationals of the Republic
110of Latvia shall be understood as referring to nationals of
111European Community Member States. References in this Agreement to
112airline or airlines of the Republic of Latvia shall be understood
113as referring to airline or airlines designated by the Republic of
114Latvia.
115Article 2
116Grant of traffic rights
1171. Each Contracting Party grants to the other Contracting
118Party the following rights in respect of the international air
119services:
120a) the right to fly across its territory without landing;
121b) the right to make stops in its territory for non-traffic
122purposes.
1232. Each Contracting Party grants to the other Contracting
124Party the rights specified in this Agreement for the purpose of
125operating international air services on the routes specified in
126the Annex to this Agreement. Such services and routes are
127hereinafter called "the agreed services" and
128"the specified routes" respectively. While
129operating an agreed service on a specified route the airline or
130airlines designated by each Contracting Party shall enjoy, in
131addition to the rights specified in paragraph 1 of this Article,
132the right to make stops in the territory of the other Contracting
133Party at the points specified for that route in the Annex for the
134purpose of taking on and/or discharging international traffic in
135passengers, baggage, cargo and mail, separately or in combination
136on a commercial basis.
1373. Nothing in paragraph 2 of this Article shall be deemed to
138confer on a designated airline of one Contracting Party the right
139of taking on board, in the territory of the State of other
140Contracting Party, passengers, cargo and mail carried for
141remuneration or hire and destined for another point in the
142territory of the State that other Contracting Party
143(cabotage).
1444. If because of armed conflict, political disturbances or
145developments, or special and unusual circumstances, a designated
146airline of one Contracting Party is unable to operate a service
147on its normal routing, the other Contracting Party shall use its
148best efforts to facilitate the continued operation of such
149service through appropriate temporary rearrangements of
150routes.
151Article 3
152Recognition of certificates and licences
1531. Certificate of airworthiness, certificates of competency
154and licences issued or rendered valid by one of the Contracting
155Parties shall, during the period of their validity, be recognized
156as valid by the other Contracting Party, provided that the
157requirements under which such certificates or licences were
158issued or rendered valid are equal to or above the minimum
159standards which may be established pursuant to the
160Convention.
1612. Each Contracting Party reserves the right to refuse to
162recognize as valid, for the purpose of flights over its own
163territory, certificate of competency and licences granted to or
164rendered valid for its own nationals by the other Contracting
165Party or by any other State.
166Article 4
167Designation of airlines and operating authorization
1681. Each Contracting Party shall have the right to designate
169airline(s) for the purpose of operating the agreed services on
170the specified routes, notifying the other Contracting Party in
171writing.
1722. Each Contracting Party shall have the right to withdraw or
173alter such designation by written notification to other
174Contracting Party.
1753. On receipt of such a designation the other Contracting
176Party shall grant the appropriate authorisations and permissions
177with minimum procedural delay, provided:
178a) In the case of an airline designated by the Republic of
179Latvia:
180i) it is established in the territory of the Republic of
181Latvia under the Treaty establishing the European Community and
182has a valid Operating Licence in accordance with European
183Community law; and
184ii) effective regulatory control of the airline is exercised
185and maintained by the European Community Member State responsible
186for issuing its Air Operator's Certificate and the relevant
187aeronautical authority is clearly identified in the
188designation.
189b) In the case of an airline designated by the Republic of
190Armenia:
191i) it is established in the territory of the Republic of
192Armenia and is licensed in accordance with the legislation of the
193Republic of Armenia; and
194ii) effective regulatory control of the airline is exercised
195and maintained by the Republic of Armenia responsible for issuing
196its Air Operator's Certificate and the relevant aeronautical
197authority is clearly identified in the designation.
198c) The aeronautical authorities of one Contracting Party may
199require an airline designated by the other Contracting Party to
200satisfy them that it is qualified to fulfil the conditions
201prescribed under the laws and regulations normally and reasonably
202applied to the operation of international air services by such
203authorities in conformity with the provisions of the
204Convention.
2054. When an airline has been so designated and authorized it
206may begin at any time to operate the agreed services, provided
207that the airline complies with all applicable provisions of this
208Agreement, including those relating to tariffs.
209Article 5
210Refusal, revocation or suspension of operating authorization
2111. Either Contracting Party may revoke, suspend or limit the
212operating authorisation or technical permissions of an airline
213designated by the other Contracting Party where:
214a) In the case of an airline designated by the Republic of
215Latvia:
216i) it is not established in the territory of the Republic of
217Latvia under the Treaty establishing the European Community or
218does not have a valid Operating Licence in accordance with
219European Community law; or
220ii) effective regulatory control of the airline is not
221exercised or not maintained by the European Community Member
222State responsible for issuing its Air Operator's Certificate, or
223the relevant aeronautical authority is not clearly identified in
224the designation.
225b) In the case of an airline designated by the Republic of
226Armenia:
227i) it is not established in the territory of the Republic of
228Armenia or is not licensed in accordance with the legislation of
229the Republic of Armenia; or
230ii) effective regulatory control of the airline is not
231exercised and maintained by the Republic of Armenia responsible
232for issuing its Air Operator's Certificate or the relevant
233aeronautical authority is not clearly identified in the
234designation.
235c) in the case of failure by that airline to comply with the
236laws and regulations of the Contracting Party granting these
237rights, or
238d) in any case in which that airline otherwise fails to
239operate the agreed services in accordance with the conditions
240prescribed under this Agreement.
241e) in the case of failure by the other Contracting Party to
242comply with or apply the Security and Safety standards in
243accordance with Articles 15 and 16 of this Agreement.
2442. Unless immediate revocation, suspension or imposition of
245the conditions mentioned in paragraph 1 of this Article is
246essential to prevent further infringements of laws and/or
247regulations, such right shall be exercised only after
248consultations with the aeronautical authorities of the other
249Contracting Party. Such consultations shall begin within a period
250of thirty (30) days from the date of a request for
251consultations.
252Article 6
253Non-discrimination in respect of charges
2541. The charges levied in the territory of either Contracting
255Party for the use of airports and other aviation facilities by
256the aircraft of any designated airline of the other Contracting
257Party shall not be higher than those levied on aircraft of
258national airline engaged in similar international air
259services.
2602. The charges for the use of airports, or any other aviation
261services and facilities, or any similar charges or fees levied in
262connection with the operation of international air services shall
263be assessed on a cost-related basis; presentation of the relevant
264proof may be requested. The same applies to charges for handling
265passengers, baggage and cargo and for handling aircraft at
266airports with only one provider.
2673. The charges and fees shall be expressed and payable in
268national currency.
269Article 7
270Exemption from customs and other duties
2711. Aircraft operated on international air services by a
272designated airline of one Contracting Party, as well as their
273regular equipment, spare parts, supplies of fuel and lubricants,
274aircraft stores (including food, beverages and tobacco) on board
275such aircraft shall be exempted from all customs duties,
276inspection fees and other similar charges on arriving in the
277territory of the other Contracting Party, provided such
278equipment, spare parts, supplies and stores remain on board the
279aircraft up to such time as they are re-exported or are used or
280consumed by such aircraft on flights over that territory.
2812. There shall also be an exemption from the duties, fees and
282charges referred to in paragraph 1 of this Article, with the
283exception of charges based on the cost of the service
284provided:
285a) aircraft stores taken on board in the territory of one
286Contracting Party within reasonable limits, for use on an
287outbound aircraft engaged in an international air service of a
288designated airline of the other Contracting Party;
289b) spare parts, including engines, introduced into the
290territory of one Contracting Party for the maintenance or repair
291of aircraft engaged in an international air service of a
292designated airline of the other Contracting Party;
293c) fuel, lubricants and consumable technical supplies
294introduced into or supplied in the territory of one Contracting
295Party for use in an international air service of a designated
296airline of the other Contracting Party, even when these supplies
297are to be used on the part of the journey performed over the
298territory of the other Contracting Party, in which territory they
299are taken on board.
3003. Materials referred to in paragraph 2 of this Article may be
301required to be kept under Customs supervision or control.
3024. The regular airborne equipment, as well as the materials,
303supplies and spare parts normally retained on board aircraft
304operated by a designated airline of one Contracting Party, may be
305unloaded in the territory of the other Contracting Party only
306with the approval of the customs authorities of that Contracting
307Party. In such case, they may be placed under the supervision of
308the said authorities up to such time as they are re-exported or
309otherwise disposed of in accordance with customs regulations.
3105. Necessary documents, such as timetables, air tickets and
311air waybills, intended for the use of a designated airline of one
312Contracting Party and introduced into the territory of the other
313Contracting Party, shall be exempted from customs duties and
314taxes in the latter territory.
3156. Baggage and cargo in direct transit across the territory of
316a Contracting Party shall be exempted from customs duties, fees
317and other similar charges not based on the cost of services on
318arrival or departure.
3197. Nothing in this Agreement shall prevent both Contracting
320Parties from imposing, on a non-discriminatory basis, taxes,
321levies, duties, fees or charges on fuel supplied in its territory
322for use in an aircraft of a designated air carrier of the
323Republic of Armenia that operates between a point in the
324territory of the Republic of Latvia and another point in the
325territory of the Republic of Latvia or in the territory of
326another European Community Member State.
327Article 8
328Capacity provisions
3291. The designated airlines of the Contracting Parties shall be
330afforded fair and equal treatment in order that they may enjoy
331equal opportunities in the operation of the agreed services on
332the specified routes.
3332. In operating the agreed services the designated airlines of
334each Contracting Party shall take into account the interests of
335the designated airlines of the other Contracting Party so as not
336to affect unduly the services which the latter provide on the
337whole or part of the same routes.
3383. The agreed services provided by the designated airlines of
339the Contracting Parties shall have as their primary objective the
340provision, at a reasonable load factor, of capacity adequate to
341carry the current and reasonably anticipated requirements for
342carriage of passengers, cargo and mail between the territory of
343the State of the Contracting Party designating the airline and
344the territory of the State of the other Contracting Party.
3454. Provision for the carriage of passengers, cargo and mail
346both taken on board and discharged at points on routes to be
347specified in the territories of States other than that
348designating the airline shall be agreed upon between the two
349Contracting Parties.
3505. The capacity to be provided including the frequency of
351services and the type of aircraft to be used by the designated
352airlines of the Contracting Parties on the agreed services shall
353be agreed upon by the Aeronautical Authorities.
3546. In case of disagreement between the Contracting Parties,
355the issue referred to in paragraph (5) above shall be settled in
356accordance with the provisions of Article 17 and Article 18 of
357this Agreement. Until such agreement has been reached, the
358capacity provided by the designated airlines shall remain
359unchanged.
360Article 9
361Approval of traffic programmes
3621. The airline or airlines designated by one Contracting Party
363shall submit its or their traffic programmes (for the Summer and
364Winter Traffic periods) for approval to the aeronautical
365authorities of the other Contracting Party at least thirty (30)
366days prior to the beginning of the operation. The programme shall
367include in particular the timetables, the frequency of the
368services and the types of aircraft to be used. The aeronautical
369authorities shall give their decision on such traffic programme
370submissions within twenty (20) days from the date the airline
371concerned submits its programme for approval.
3722. Each alteration in the traffic programme as well as
373requests for permission to operate additional flights shall be
374submitted by the airline or airlines designated by one
375Contracting Party for approval to the aeronautical authorities of
376the other Contracting Party. Such requests for alteration or for
377additional flights shall be dealt with promptly by the
378aeronautical authorities.
379Article 10
380Information and statistics
381The aeronautical authorities of either Contracting Party shall
382supply to the aeronautical authorities of the other Contracting
383Party, at their request, such information and statistics relating
384to traffic carried on the agreed services by the designated
385airline or airlines of the first Contracting Party to and from
386the territory of the other Contracting Party as may normally be
387prepared and submitted to its national aeronautical authorities.
388Any additional statistical traffic data which the aeronautical
389authorities of one Contracting Party may desire shall, upon
390request, be a subject of mutual discussion and agreement between
391the aeronautical authorities of the two Contracting Parties.
392Article 11
393Tariffs
3941. The tariffs to be charged by a designated airline for
395passengers on the routes specified in accordance with paragraph 2
396of Article 2 of this Agreement shall be subject to approval by
397the aeronautical authorities of the Contracting Party in whose
398territory the point of departure of the journey (according to the
399information in the transport documents) is situated.
4002. In their tariffs, the designated airlines shall take into
401account the cost of operation, a reasonable profit, the
402prevailing conditions of competition and of the market as well as
403the interests of transport users. The competent aeronautical
404authorities may refuse to approve a tariff only if it does not
405comply with these criteria.
4063. The tariffs shall be submitted by the designated airlines
407to the aeronautical authorities for approval at least thirty (30)
408days prior to the envisaged date of their introduction.
4094. If the aeronautical authorities of either Contracting Party
410do not consent to a tariff submitted for their approval, they
411shall inform the airline concerned within twenty (20) days after
412the date of submission of the tariff. In such case, this shall
413not be applied. The tariff applied up to that time which was to
414be replaced by the new tariff shall continue to be applied.
4155. Notwithstanding the provisions of this Article, the tariffs
416to be charged by the designated airline or airlines of the
417Republic of Armenia for carriage wholly within the European
418Community shall be subject to European Community law.
419Article 12
420Fair competition
4211. There shall be fair and equal opportunity for the
422designated airlines of both Contracting Parties to participate in
423international air transportation covered by this Agreement.
4242. Each Contracting Party shall, where necessary, take all
425appropriate action within its jurisdiction to eliminate all forms
426of discrimination or unfair competitive practices adversely
427affecting the competitive position of the airlines of the other
428Contracting Party.
429Article 13
430Commercial activities
4311. The designated airline or airlines of each Contracting
432Party shall have the right to maintain in the territory of the
433other Contracting Party, within the scope of the laws and
434regulations in force therein, such offices and administrative,
435commercial and technical personnel as may be necessary for the
436requirements of the designated airline concerned.
4372. The establishment of the offices and the employment of the
438personnel referred to in paragraph 1 shall be subject to the laws
439and regulations of the Contracting Party concerned, such as the
440laws and regulations relating to the admission of foreigners and
441their stay in the territory of the Contracting Party concerned.
442The personnel employed in the offices according to paragraph 1
443above shall be granted work permits upon application, regardless
444of the situation and the development of the labour market.
4453. The designated airlines of the Contracting Parties shall be
446free to sell air transport services on their own transportation
447documents in the territories of both Contracting Parties, either
448directly or through an agent, in the national currency. Each
449Contracting Party shall refrain from restricting the right of the
450designated airline or airlines of the other Contracting Party to
451sell, and of any person to purchase such transportation.
452Article 14
453Aviation security
4541. Consistent with their rights and obligations under
455international law, the Contracting Parties reaffirm that their
456obligation to each other to protect the security of civil
457aviation against acts of unlawful interference forms an integral
458part of this Agreement. Without limiting the generality of their
459rights and obligations under international law, the Contracting
460Parties shall in particular act in conformity with the provisions
461of the Convention on Offences and Certain Other Acts Committed on
462Board Aircraft, signed at Tokyo on 14 September 1963, the
463Convention for the Suppression of Unlawful Seizure of Aircraft,
464signed at the Hague on 16 December 1970 and the Convention for
465the Suppression of Unlawful Acts against the Safety of Civil
466Aviation, signed at Montreal on 23 September 1971 and the
467Protocol for the Suppression of Unlawful Acts of Violence at
468Airports Serving International Civil Aviation, signed at Montreal
469on February 24 1988 or any other aviation security convention to
470which the two Contracting Parties may adhere.
4712. The Contracting Parties shall provide upon request all
472necessary assistance to each other to prevent acts of unlawful
473seizure of civil aircraft and other unlawful acts against the
474safety of such aircraft, their passengers and crew, airports and
475air navigation facilities, and any other threat to the security
476of civil aviation.
4773. The Contracting Parties shall act in conformity with the
478aviation security provisions and technical requirements
479established by the International Civil Aviation Organization and
480designated as Annexes to the Convention to the extent that such
481security provisions and requirements are applicable to the
482Contracting Parties; they shall require that operators of
483aircraft of their registry or operators of aircraft who have
484their principal place of business or permanent residence in their
485State's territory act in conformity with such aviation security
486provisions.
4874. Each Contracting Party agrees that such operators of
488aircraft may be required to observe the aviation security
489provisions and requirements referred to in paragraph 3 above
490required by the other Contracting Party for entry into, departure
491from, or while within the territory of that other Contracting
492Party. Under the law applicable each Contracting Party shall
493ensure that adequate measures are effectively applied within its
494territory to protect the aircraft and to inspect passengers,
495crew, carry-on items, baggage, cargo and aircraft stores prior to
496and during boarding or loading. Each Contracting Party shall also
497give sympathetic consideration to any request from the other
498Contracting Party for reasonable special security measures to
499meet a particular threat.
5005. When an incident or threat of an incident of unlawful
501seizure of civil aircraft or other unlawful acts against the
502safety of such aircraft, their passengers and crew, airports or
503air navigation facilities occurs, the Contracting Parties shall
504assist each other by facilitating communications and other
505appropriate measures intended to terminate rapidly and safely
506such incident or threat thereof.
5076. Should a Contracting Party depart from the aviation
508security provisions of this Article, the aeronautical authorities
509of the other Contracting Party may request immediate
510consultations with the aeronautical authorities of the former
511Contracting Party. Failure to reach a satisfactory agreement
512within one month of the date of such request shall constitute
513grounds for withholding, revoking, limiting or imposing
514conditions on the operating authorization of an airline or
515airlines of the former Contracting Party. If required by a
516serious emergency, either Contracting Party may take interim
517action prior to the expiry of the month.
518Article 15
519Aviation safety
5201. Each Contracting Party may request consultations at any
521time concerning safety standards in any area relating to aircrew,
522aircraft or their operation adopted by the other Contracting
523Party. Such consultations shall take place within thirty (30)
524days of that request.
5252. If, following such consultations, one Contracting Party
526finds that the other Contracting Party does not effectively
527maintain and administer safety standards in any such area that
528are at least equal to the minimum standards established at that
529time pursuant to the Convention, the first Contracting Party
530shall notify the other Contracting Party of those findings and
531the steps considered necessary to conform with those minimum
532standards, and that other Contracting Party shall take
533appropriate corrective action. Failure by the other Contracting
534Party to take appropriate action within fifteen (15) days or such
535longer period as may be agreed, shall be grounds for the
536application of Article 5 of this Agreement.
5373. Notwithstanding the obligations mentioned in Article 33 of
538the Convention it is agreed that any aircraft operated by or,
539under the lease agreement, on behalf of the airline or airlines
540of one Contracting Party on services to or from the territory of
541the State of another Contracting Party may, while within the
542territory of the State of other Contracting Party, be made the
543subject of an examination by the authorized representatives of
544the other Contracting Party, on board and around the aircraft to
545check both the validity of the aircraft documents and those of
546its crew and the apparent condition of the aircraft and its
547equipment (in this Article called "ramp inspection"),
548provided this does not lead to unreasonable delay.
5494. If any such ramp inspection or series of ramp inspections
550gives rise to:
551a) serious concerns that an aircraft or the operation of an
552aircraft does not comply with the minimum standards established
553at the time pursuant to the Convention, or
554b) serious concerns that there is a lack of effective
555maintenance and administration of safety standards established at
556that time pursuant to the Convention,
557the Contracting Party carrying out the inspection shall, for
558the purposes of Article 33 of the Convention, be free to conclude
559that the requirements under which the certificate or licences in
560respect of that aircraft or in respect of the crew of that
561aircraft had been issued or rendered valid, or that the
562requirements under which that aircraft is operated, are not equal
563to or above the minimum standards established pursuant to the
564Convention.
5655. In the event that access for the purpose of undertaking a
566ramp inspection of an aircraft operated by, or, on behalf of the
567airline of one Contracting Party in accordance with paragraph 3
568of this Article is denied by the representative of that airline
569or airlines, the other Contracting Party shall be free to infer
570that serious concerns of the type referred to in paragraph 4
571above arise and draw the conclusions referred to in that
572paragraph.
5736. Each Contracting Party reserves the right to suspend or
574vary the operating authorization of an airline or airlines of the
575other Contracting Party immediately in the event the first
576Contracting Party concludes, whether as a result of a ramp
577inspection, a series of ramp inspections, a denial of access for
578ramp inspection, consultations or otherwise, that immediate
579action is essential to the safety of an airline operation.
5807. Any action by one Contracting Party in accordance with
581paragraph 2 or 6 above shall be discontinued once the basis for
582the taking of that action ceases to exist.
583Article 16
584Application of laws and regulations
5851. The laws and regulations of the State of one Contracting
586Party relating to the entry into, or departure from its State's
587territory of aircraft engaged in international air services or to
588the operation and navigation of such aircraft while in the said
589State's territory shall apply to the designated airline or
590airlines of the other Contracting Party.
5912. The laws and regulations of the State of one Contracting
592Party governing entry into, stay in or departure from its State's
593territory of passengers, crew, cargo or mail, such as formalities
594regarding entry, exit, emigration, immigration, customs,
595currency, health and quarantine shall apply to passengers, crew,
596cargo and mail carried by the aircraft of the designated airline
597or airlines of the other Contracting Party, while they are within
598the said territory.
5993. Passengers, baggage and cargo in direct transit across the
600territory of either Contracting Party and not leaving the area of
601the airport reserved for such purposes shall, except in respect
602of security measures against acts of violence, air piracy, as
603well as smuggling of narcotic drugs, be subject to no more than a
604simplified control.
6054. In case a carried passenger fails to comply with laws and
606regulations for enter into the country of other Contracting Party
607an airline is obliged to transport him back on costs of this
608airline.
609Article 17
610Consultations
611In a spirit of close co-operation the aeronautical authorities
612of the Contracting Parties shall consult each other from time to
613time with a view to ensure the implementation of and satisfactory
614compliance with the provisions of this Agreement and the Annex
615thereto.
616Article 18
617Settlement of disputes
6181. If any dispute arises between the Contracting Parties
619relating to the interpretation or application of this Agreement,
620the Contracting Parties shall, in the first place, endeavour to
621settle it by negotiation.
6222. If the Contracting Parties fail to reach a settlement by
623negotiation, they may agree to refer the dispute for decision to
624some person or body; if they do not so agree, the dispute shall,
625at the request of either Contracting Party, be submitted for
626decision to a tribunal of three arbitrators, one to be nominated
627by each Contracting Party and the third to be appointed by the
628two so nominated. Each of the Contracting Parties shall nominate
629an arbitrator within a period of sixty (60) days from the date of
630receipt by either Contracting Party from the other Contracting
631Party of a notice through diplomatic channels requesting
632arbitration of the dispute by such a tribunal, and the third
633arbitrator shall be appointed within a further period of sixty
634(60) days.
635If either of the Contracting Parties fails to nominate an
636arbitrator within the period specified, the President of the
637Council of the International Civil Aviation Organization may at
638the request of either Contracting Party appoint an arbitrator or
639arbitrators as the case requires. In all cases, the third
640arbitrator shall be a national of a third State and shall act as
641President of the arbitral tribunal. The arbitral tribunal shall
642reach its decision by majority of votes. In all other respects
643the arbitral tribunal shall determine its own procedure.
6443. The Contracting Parties undertake to comply with any
645decisions given under paragraph 2 of this Article.
6464. If and for so long as either Contracting Party fails to
647comply with a decision given under paragraph 2 of this Article,
648the other Contracting Party may limit, suspend or revoke any
649rights or privileges which it has granted by virtue of this
650Agreement to the Contracting Party in defaults.
6515. Each Contracting Party shall bear the expenses and
652remuneration necessary for its arbitrator; the fee for the third
653arbitrator and the expenses necessary for this one as well as
654those due to the activity of the arbitration shall be equally
655shared by the Contracting Parties.
656Article 19
657Amendments
6581. If either of the Contracting Party desires to modify any
659provision of this Agreement including an annex, it should be
660after consultation in accordance with Article 17 of this
661Agreement.
6622. This Agreement may be modified and supplemented by mutual
663consent of both Contracting Parties. Such amendment and
664supplements shall be made in a form of separate protocols being
665an integral part of this Agreement and shall enter into force in
666accordance with the provisions of Article 22 of this
667Agreement.
6683. If the amendment relates only to the provisions of the
669Annex to this Agreement, it may be agreed upon directly between
670the aeronautical authorities of both Contracting Parties and
671would be effective from the date agreed upon by the aeronautical
672authorities.
673Article 20
674Registration
675This Agreement and any amendments thereto shall be registered
676with the International Civil Aviation Organization.
677Article 21
678Termination
679Either Contracting Party may at any time give notice in
680writing to the other Contracting Party of its decision to
681terminate this Agreement. Such notice shall be simultaneously
682communicated to the International Civil Aviation Organization.
683This Agreement shall terminate at midnight (at local time of the
684Contracting Party, which has received the notice) upon expiration
685of twelve (12) months from the date of receipt of the notice by
686the other Contracting Party, unless the notice is withdrawn by
687agreement before the end of this period. In the absence of
688acknowledgement of receipt by the other Contracting Party, the
689notice shall be deemed to have been received fourteen (14) days
690after receipt of the notice by the International Civil Aviation
691Organization.
692Article 22
693Entry into force
694This Agreement shall enter into force on the date of the
695receipt of the last notification through diplomatic channels on
696completion of the necessary internal procedures for the entry
697into force of this Agreement.
698Done at Yerevan this "10" day of December 2009 in two
699originals in the Latvian, Armenian and English languages. All
700texts being equally authentic. In the case of dispute, the
701English text shall prevail.
