1Definīcijas
21. Šajā Nolīgumā, ja kontekstā nav paredzēts citādi:
3a) termins "Konvencija" nozīmē Konvenciju par
4starptautisko civilo aviāciju, kas atklāta parakstīšanai Čikāgā
51944. gada 7. decembrī, un ietver jebkuru tās pielikumu, kas
6pieņemts saskaņā ar minētās Konvencijas 90. pantu, un pielikumu
7un Konvencijas jebkuru grozījumu, kas izdarīts saskaņā ar šīs
8Konvencijas 90. un 94. pantu, ciktāl šie pielikumi un grozījumi
9kļuvuši saistoši abām Līgumslēdzējām Pusēm vai tās tos savās
10valstīs ratificējušas;
11b) termins "aviācijas institūcijas" attiecībā
12uz Latvijas Republiku nozīmē Satiksmes ministriju un attiecībā uz
13Dominikānas Republiku, Civilās aviācijas pārvaldi, vai abos
14gadījumos, jebkuru personu vai institūciju, kas ir pilnvarota
15veikt minēto aviācijas institūciju pašreizējās funkcijas;
16c) termins "nozīmētā aviokompānija" nozīmē
17aviokompāniju, kura ir nozīmēta un pilnvarota saskaņā ar šā
18Nolīguma 4. pantu;
19d) termins "teritorija" attiecībā uz
20Līgumslēdzējām Pusēm tiek saprasts kā Latvijas Republikas
21teritorija vai Dominikānas Republikas teritorija, kā to prasa
22konteksts, un tam ir Konvencijas 2. pantā noteiktā nozīme, un to
23izsaka šādi: "Šajā konvencijā par valsts teritoriju uzskata
24sauszemes platības un tām blakus esošos teritoriālos ūdeņus, uz
25kuriem attiecas šīs valsts suverenitāte, sizerēnā vara,
26aizsardzība vai pilnvaras";
27e) terminam "suverenitāte" šā Nolīguma
28izpratnē ir Konvencijas 1. pantā noteiktā nozīme un to
29izsaka šādi: "Līgumslēdzējas valstis atzīst, ka ikvienai
30valstij ir pilnīga un ekskluzīva suverenitāte savas teritorijas
31gaisa telpā ";
32f) terminiem "gaisa satiksme",
33"starptautiskā gaisa satiksme",
34"aviokompānija" un "apstāšanās
35nekomerciālos nolūkos" ir Konvencijas 96. pantā
36noteiktās nozīmes;
37g) termins "cenas" nozīmē cenas, kas
38iekasējamas par pasažieru, bagāžas vai kravas pārvadājumiem
39(izņemot pastu), tostarp jebkurus nozīmīgus papildu labumus, kas
40jāsniedz vai jāpadara pieejamus saistībā ar šādiem pārvadājumiem,
41un komisijas maksu, kas jāmaksā par pasažieru pārvadājumu biļešu
42pārdošanu vai atbilstošiem kravas pārvadājumu darījumiem. Tas
43ietver arī nosacījumus, kas reglamentē pārvadājuma cenas
44piemērojamību vai komisijas maksu;
45h) termins "pielikums" nozīmē šā Nolīguma
46pielikumu. Pielikums veido šā Nolīguma neatņemamu sastāvdaļu un
47visas atsauces uz šo Nolīgumu ietver arī atsauces uz pielikumu,
48ja vien nav skaidri noteikts citādi;
49i) termins "ES Līgumi" nozīmē Līgumu
50par Eiropas Savienību un Līgumu par Eiropas Savienības
51darbību.
522. Šā Nolīguma pantiem dotie nosaukumi ir tikai atsauces
53nolūkiem.
543. Šā Nolīguma izpratnē atsauces uz Latvijas Republikas
55pilsoņiem nozīmē atsauces uz Eiropas Savienības dalībvalstu
56pilsoņiem. Šā Nolīguma izpratnē atsauces uz Latvijas Republikas
57aviokompāniju vai aviokompānijām nozīmē atsauces uz Latvijas
58Republikas nozīmētu aviokompāniju vai aviokompānijām.
1Tiesību piešķiršana
21. Lai veiktu starptautisko gaisa satiksmi, katra
3Līgumslēdzēja Puse piešķir otrai Līgumslēdzējai Pusei šādas
4tiesības:
5a) tiesības bez apstāšanās lidot pāri tās teritorijai;
6b) tiesības apstāties tās teritorijā nekomerciālos
7nolūkos.
82. Katra Līgumslēdzēja Puse piešķir otrai Līgumslēdzējai Pusei
9šajā Nolīgumā noteiktās tiesības veikt starptautisko gaisa
10satiksmi šā Nolīguma pielikumā noteiktajos maršrutos. Šādu
11satiksmi un maršrutus turpmāk dēvē attiecīgi par "Nolīgumā
12paredzēto satiksmi" un "noteiktajiem maršrutiem".
13Veicot Nolīgumā paredzēto satiksmi noteiktajā maršrutā, katras
14Līgumslēdzējas Puses nozīmētajai aviokompānijai vai
15aviokompānijām, papildus šā panta 1. daļā noteiktajām
16tiesībām, ir tiesības apstāties otras Līgumslēdzējas Puses
17teritorijā punktos, kas noteikti konkrētajam maršrutam pielikumā,
18lai uzņemtu un/vai izlaistu komerciāli pārvadātos starptautiskās
19satiksmes pasažierus, bagāžu, kravu un pastu, atsevišķi vai
20kopā.
213. Nekas šā panta 2. daļā nevar tikt iztulkots kā vienas
22Līgumslēdzējas Puses nozīmētās aviokompānijas tiesības uzņemt
23otras Līgumslēdzējas Puses teritorijā pasažierus, kravu un pastu,
24lai tos par atlīdzību vai uz nomas līguma pamata nogādātu uz citu
25punktu šīs otras Līgumslēdzējas Puses teritorijā (kabotāža).
264. Ja bruņota konflikta, politisko nemieru vai notikumu, vai
27citu īpašu un neparastu apstākļu dēļ vienas Līgumslēdzējas Puses
28nozīmētā aviokompānija nespēj veikt satiksmi savā parastajā
29maršrutā, tad otra Līgumslēdzēja Puse dara visu iespējamo, lai
30sekmētu šādas satiksmes nepārtrauktību, attiecīgi īslaicīgi
31pārkārtojot maršrutus.
1Apliecību un licenču atzīšana
21. Lidojumu drošības apliecības, kvalifikācijas apliecības un
3licences, kuras izsniegusi vai atzinusi par derīgām vienas
4Līgumslēdzējas Puses kompetentā institūcija, to derīguma termiņa
5ietvaros par derīgām atzīst otra Līgumslēdzēja Puse, ja prasības,
6saskaņā ar kurām šīs apliecības vai licences izsniegtas vai
7atzītas par derīgām, atbilst Konvencijas noteiktajiem
8minimālajiem standartiem vai ir augstākas par tiem.
92. Katra Līgumslēdzēja Puse tomēr saglabā tiesības atteikties
10atzīt par derīgām kvalifikācijas apliecības un licences, kuras
11tās valsts pilsoņiem lidojumiem virs tās teritorijas izsniegusi
12vai atzinusi par derīgām otra Līgumslēdzēja Puse vai jebkura cita
13valsts.
1Aviokompāniju nozīmēšana un pārvadājumu atļaujas izsniegšana
21. Lai veiktu šajā Nolīgumā paredzēto satiksmi noteiktajos
3maršrutos, katrai Līgumslēdzējai Pusei ir tiesības rakstiski pa
4diplomātiskajiem kanāliem nozīmēt otrai Līgumslēdzējai Pusei
5vienu vai vairākas aviokompānijas.
62. Katrai Līgumslēdzējai Pusei ir tiesības atsaukt vai grozīt
7šādu nozīmējumu ar rakstisku paziņojumu otrai Līgumslēdzējai
8Pusei.
93. Šādu nozīmējumu saņemot, otra Līgumslēdzēja Puse piešķir
10attiecīgas pilnvaras un atļaujas ar minimālu procesuālo
11kavēšanos, ja:
12a) gadījumā, kad aviokompāniju nozīmē Latvijas Republika:
13i) tā ir reģistrēta Latvijas Republikas teritorijā saskaņā ar
14ES Līgumiem un tai ir derīga licence par tiesībām veikt gaisa
15pārvadājumus saskaņā ar Eiropas Savienības tiesību aktiem; un
16ii) aviokompānijas faktisko regulējošo kontroli veic un uztur
17Eiropas Savienības dalībvalsts, kas atbild par gaisa kuģa
18ekspluatanta apliecības izsniegšanu, un nozīmējumā ir skaidri
19norādīta attiecīgā aviācijas institūcija; un
20iii) aviokompānija tieši vai caur akciju kontrolpaketi pieder
21un to faktiski kontrolē Eiropas Savienības dalībvalstis vai
22Eiropas Brīvās tirdzniecības asociācijas dalībvalstis un/vai šo
23valstu pilsoņi;
24b) gadījumā, kad aviokompāniju nozīmē Dominikānas
25Republika:
26i) tā ir reģistrēta, izveidota un licencēta saskaņā ar
27Dominikānas Republikas piemērojamajiem normatīvajiem aktiem ar
28galveno uzņēmājdarbības vietu tās valsts teritorijā; un
29ii) aviokompānijas faktisko regulējošo kontroli veic un uztur
30Dominikānas Republika, kas atbild par gaisa kuģa ekspluatanta
31apliecības izsniegšanu, un nozīmējumā ir skaidri norādīta
32attiecīgā aviācijas institūcija; un
33c) vienas Līgumslēdzējas Puses aviācijas institūcijas var
34pieprasīt, lai otras Līgumslēdzējas Puses nozīmētā aviokompānija
35tām pierāda, ka spēj pildīt normatīvos aktus, ko šīs institūcijas
36parasti un pamatoti piemēro starptautiskās gaisa satiksmes
37veikšanai saskaņā ar Konvencijas noteikumiem.
38d) Aviokompāniju nozīmējošā Līgumslēdzējas Puse atbilst šā
39Nolīguma 16. un 17. panta noteikumiem; un
404. Ja aviokompānija ir šādi nozīmēta un pilnvarota, tā jebkurā
41laikā var uzsākt šajā Nolīgumā paredzēto satiksmi, ja
42aviokompānija atbilst visiem piemērojamajiem šā Nolīguma
43noteikumiem, ieskaitot tos, kas attiecas uz cenām.
1Pārvadājuma atļaujas atteikšana, atsaukšana vai apturēšana
21. Ikviena Līgumslēdzējas Puses aviācijas institūcija var
3atteikt, atsaukt vai ierobežot otras Līgumslēdzējas Puses
4nozīmētās aviokompānijas pārvadājumu atļauju vai tehniskās
5atļaujas, ja:
6a) gadījumā, kad aviokompāniju nozīmē Latvijas Republika:
7i) tā nav reģistrēta Latvijas Republikas teritorijā saskaņā ar
8ES Līgumiem vai tai nav derīga licence par tiesībām veikt gaisa
9pārvadājumus saskaņā ar Eiropas Savienības tiesību aktiem;
10vai
11ii) aviokompānijas faktisko regulējošo kontroli neveic vai
12neuztur Eiropas Savienības dalībvalsts, kas atbild par gaisa kuģa
13ekspluatanta apliecības izsniegšanu, vai nozīmējumā nav skaidri
14norādīta attiecīgā aviācijas institūcija; vai
15iii) aviokompānija tieši vai caur akciju kontrolpaketi
16nepieder vai to faktiski nekontrolē Eiropas Savienības
17dalībvalstis vai Eiropas Brīvās tirdzniecības asociācijas
18dalībvalstis un/vai šo valstu pilsoņi;
19b) gadījumā, kad aviokompāniju nozīmē Dominikānas
20Republika:
21i) tā nav reģistrēta, izveidota un licencēta saskaņā ar
22Dominikānas Republikas piemērojamajiem normatīvajiem aktiem ar
23galveno uzņēmājdarbības vietu tās valsts teritorijā; vai
24ii) aviokompānijas faktisko regulējošo kontroli neveic un
25neuztur Dominikānas Republika, kas atbild par gaisa kuģa
26ekspluatanta apliecības izsniegšanu, vai nozīmējumā nav skaidri
27norādīta attiecīgā aviācijas institūcija; vai
28c) ja šī aviokompānija nespēj izpildīt Līgumslēdzējas Puses,
29kas piešķīrusi šīs tiesības, piemērojamos normatīvos aktus,
30vai
31d) jebkurā gadījumā, ja šī aviokompānija citādi nespēj veikt
32Nolīgumā paredzēto satiksmi saskaņā ar šajā Nolīgumā
33paredzētajiem nosacījumiem, vai
34e) ja otra Līgumslēdzēja Puse neievēro vai nepiemēro aviācijas
35un lidojumu drošības standartus saskaņā ar šā Nolīguma 16. un 17.
36pantu.
372. Ja vien šā panta 1. daļā minētā tūlītējā atcelšana,
38apturēšana vai nosacījumu piemērošana nav būtiska, lai novērstu
39turpmākus likumu un noteikumu pārkāpumus, šādas tiesības izmanto
40tikai pēc konsultācijām ar otras Līgumslēdzējas Puses aviācijas
41institūcijām. Šādas konsultācijas sākas trīsdesmit (30) dienu
42laikā no konsultāciju pieprasīšanas dienas.
1Nediskriminācija attiecībā uz maksām
2Katra Līgumslēdzēja Puse nodrošina, ka maksas, ko tās
3kompetentās maksas iekasēšanas institūcijas vai iestādes var
4uzlikt otras Līgumslēdzējas Puses aviokompānijām par
5aeronavigācijas un gaisa satiksmes kontroles pakalpojumu,
6lidostas, aviācijas drošības un ar to saistīto iekārtu un
7pakalpojumu izmantošanu, tiek noteiktas saskaņā ar katras
8Līgumslēdzējas Puses normatīvajiem aktiem un nav nepamatoti
9diskriminējošas. Jebkurā gadījumā, jebkura šāda maksa tiek
10piemērota otras Līgumslēdzējas Puses aviokompānijām ar
11noteikumiem, kas nav mazāk izdevīgi par visizdevīgākajiem
12noteikumiem, kādi ir pieejami jebkurai citai aviokompānijai.
1Atbrīvošana no muitas un citiem nodokļiem
21. Vienas Līgumslēdzējas Puses nozīmētās aviokompānijas gaisa
3kuģis, kas veic starptautisko gaisa satiksmi, kā arī tā parastais
4aprīkojums, rezerves daļas, degvielas un smērvielu krājumi, gaisa
5kuģa krājumi (ieskaitot pārtiku, dzērienus un tabakas
6izstrādājumus), kas atrodas šajā gaisa kuģī, tam ierodoties otras
7Līgumslēdzējas Puses teritorijā, tiek atbrīvoti, pamatojoties uz
8savstarpīgumu, no visiem muitas nodokļiem, pārbaudes maksājumiem
9un citiem līdzīgiem maksājumiem saskaņā ar katrā Līgumslēdzējā
10Pusē spēkā esošajiem normatīvo aktu nosacījumiem, ja šis
11aprīkojums, rezerves daļas un krājumi paliek gaisa kuģī līdz to
12izvešanai vai izmantošanai vai patērēšanai šajā gaisa kuģī,
13lidojot pāri tās teritorijai.
142. No šā panta 1. daļā minētajiem nodokļiem un maksājumiem,
15izņemot maksas par sniegtajiem pakalpojumiem, atbrīvo arī:
16a) gaisa kuģa krājumus, kas uzņemti gaisa kuģī vienas
17Līgumslēdzējas Puses teritorijā saprātīgos daudzumos izmantošanai
18otras Līgumslēdzējas Puses nozīmētās aviokompānijas izlidojošā
19gaisa kuģī, kas veic starptautisko gaisa satiksmi;
20b) rezerves daļas, ieskaitot dzinējus, kas ievesti vienas
21Līgumslēdzējas Puses teritorijā, lai veiktu otras Līgumslēdzējas
22Puses nozīmētās aviokompānijas gaisa kuģa, kas veic starptautisko
23gaisa satiksmi, tehnisko apkopi vai remontu;
24c) degvielu, smērvielas un patērējamos tehniskos krājumus, kas
25ievesti vai piegādāti vienas Līgumslēdzējas Puses teritorijā
26izmantošanai otras Līgumslēdzējas Puses nozīmētās aviokompānijas
27starptautiskās gaisa satiksmes veikšanai, pat ja šie krājumi tiks
28izmantoti lidojuma daļā virs tās Līgumslēdzējas Puses
29teritorijas, kurā tie uzņemti gaisa kuģī.
303. Šā panta 2. daļā minētos materiālus var pieprasīt uzglabāt
31muitas uzraudzībā vai kontrolē.
324. Parastais gaisa kuģa aprīkojums, kā arī materiāli, krājumi
33un rezerves daļas, kas parasti paliek vienas Līgumslēdzējas Puses
34nozīmētās aviokompānijas gaisa kuģī, var tikt izkrauts otras
35Līgumslēdzējas Puses teritorijā vienīgi ar šīs Līgumslēdzējas
36Puses muitas institūciju piekrišanu. Šādā gadījumā to var
37novietot minēto institūciju uzraudzībā uz laiku, līdz tas tiek
38izvests vai citādi izvietots saskaņā ar muitas noteikumiem.
395. Nepieciešamie dokumenti, piemēram, saraksti, biļetes un
40gaisa pavadzīmes, kas paredzēti vienas Līgumslēdzējas Puses
41nozīmētās aviokompānijas lietošanai un tiek ievesti otras
42Līgumslēdzējas Puses teritorijā, šajā teritorijā tiek atbrīvoti
43no muitas nodokļiem un maksājumiem.
446. Bagāža un krava tiešajā tranzītā caur Līgumslēdzējas Puses
45teritoriju tiek atbrīvota no muitas nodokļiem un citiem līdzīgiem
46maksājumiem, kas nav balstīti uz ierašanās vai izlidošanas
47pakalpojumu izmaksām.
1Kapacitātes noteikumi
21. Līgumslēdzēju Pušu nozīmētajām aviokompānijām ir taisnīgas
3un vienlīdzīgas iespējas veikt šajā Nolīgumā paredzēto satiksmi
4jebkurā šā Nolīguma pielikumā noteiktajā maršrutā.
52. Veicot šajā Nolīgumā paredzēto satiksmi, katras
6Līgumslēdzējas Puses nozīmētā aviokompānija vai aviokompānijas
7ievēro otras Līgumslēdzējas Puses nozīmētās aviokompānijas vai
8aviokompāniju intereses, lai nepamatoti neietekmētu satiksmi,
9kuru tās veic tajos pašos maršrutos vai jebkurā šo maršrutu
10daļā.
113. Veicot šajā Nolīgumā paredzēto satiksmi, Līgumslēdzēju Pušu
12nozīmēto aviokompāniju galvenais mērķis ir, ievērojot saprātīgu
13gaisa kuģa noslodzes faktoru, nodrošināt kapacitāti, kas atbilstu
14esošajam un saprātīgi paredzamajam pieprasījumam pēc pasažieru un
15kravas, ieskaitot pastu, pārvadājumiem uz aviokompāniju vai
16aviokompānijas nozīmējušās Līgumslēdzējas Puses teritoriju vai no
17tās.
184. Veicot šajā Nolīgumā paredzēto starptautisko gaisa satiksmi
19uz trešajām valstīm un no tām, tiesības šā Nolīguma pielikumā
20noteikto maršrutu punktā vai punktos gaisa kuģī uzņemt vai no tā
21izsēdināt pasažierus, iekraut vai izkraut kravu tiek izmantotas
22saskaņā ar starptautiskā gaisa transporta pareizas attīstības
23pamatprincipiem un tās atbilst pamatprincipam, ka kapacitāte ir
24saistīta ar:
25a) pieprasījumu pēc pārvadājumiem starp valsti, kur ir
26pārvadājumu sākuma punkts, un valstīm, kur ir to galapunkts;
27un
28b) pieprasījumu pēc aviokompāniju tiešajiem pārvadājumiem;
29un
30c) pieprasījumu pēc pārvadājumiem teritorijā, caur kuru
31aviokompānija veic satiksmi, ja ir ņemta vērā vietējā un
32reģionālā gaisa satiksme.
1Lidojumu sarakstu apstiprināšana
21. Vienas Līgumslēdzējas Puses nozīmētā aviokompānija vai
3aviokompānijas savā starpā koordinē, ja viena Līgumslēdzēja Puse
4pieprasa iesniegt tās vai to lidojumu sarakstus (vasaras un
5ziemas satiksmes periodiem) reģistrēšanai otras Līgumslēdzējas
6Puses aviācijas institūcijām vismaz trīsdesmit (30) dienas pirms
7pārvadājumu uzsākšanas. Sarakstā iekļauj grafikus, pakalpojumu
8biežumu un izmantojamo gaisa kuģu veidus. Aviācijas institūcijas,
9ja tas ir piemērojams, pieņem lēmumu par šādiem iesniegtajiem
10lidojumu sarakstiem divdesmit (20) dienu laikā no dienas, kad
11attiecīgā aviokompānija iesniedz savu sarakstu
12apstiprināšanai.
132. Jebkādu šo sarakstu grozījumu kā arī pieprasījumus atļaujai
14veikt papildu lidojumus vienas Līgumslēdzējas Puses nozīmētā
15aviokompānija vai aviokompānijas iesniedz apstiprināšanai otras
16Līgumslēdzējas Puses aviācijas institūcijām. Aviācijas
17institūcijas nekavējoties izskata šādus grozījumu vai papildu
18lidojumu pieprasījumus.
1Informācija un statistika
2Vienas Līgumslēdzējas Puses aviācijas institūcijas sniedz
3otras Līgumslēdzējas Puses aviācijas institūcijām pēc to
4pieprasījuma tādu informāciju un statistiku attiecībā uz pirmās
5Līgumslēdzējas Puses nozīmētās aviokompānijas vai aviokompāniju
6pārvadāto Nolīgumā paredzēto satiksmi no otras Līgumslēdzējas
7Puses teritorijas un uz to, kādu parasti sagatavotu un iesniegtu
8savām nacionālajām aviācijas institūcijām. Par jebkuru papildu
9satiksmes statistikas datu iesniegšanu, ko var vēlēties vienas
10Līgumslēdzējas Puses aviācijas institūcijas, pēc pieprasījuma
11savstarpēji apspriežas un vienojas abu Līgumslēdzēju Pušu
12aviācijas institūcijas.
1Cenas
21. Līgumslēdzējas Puses atļauj gaisa pārvadātājiem brīvi
3noteikt cenas, pamatojoties uz brīvu un godīgu konkurenci.
42. Cenas starptautiskajiem gaisa pārvadājumiem, ko veic
5saskaņā ar šo Nolīgumu, nav jāiesniedz nevienas Līgumslēdzējas
6Puses aviācijas institūcijām.
73. Neierobežojot vispārējo konkurences un patērētāju tiesību
8aktu piemērošanu katrā Līgumslēdzējā Pusē, Līgumslēdzējas Puses
9var iejaukties, lai:
10a) novērstu nepamatoti diskriminējošas cenas vai praksi;
11b) aizsargātu patērētājus pret cenām, kas ir nepamatoti
12augstas vai nepamatoti ierobežojošas vai nu dominējošā stāvokļa
13ļaunprātīgas izmantošanas dēļ, vai dēļ saskaņotām darbībām starp
14gaisa pārvadātājiem; un
15c) aizsargātu aviokompānijas no cenām, kas ir mākslīgi zemas
16tiešās vai netiešās valsts subsīdijas vai atbalsta dēļ.
1Godīga konkurence
21. Abu Līgumslēdzēju Pušu nozīmētajām aviokompānijām ir
3taisnīgas un vienlīdzīgas iespējas piedalīties starptautiskajos
4gaisa pārvadājumos, uz kuriem attiecas šis Nolīgums.
52. Katra Līgumslēdzēja Puse nepieciešamības gadījumā veic
6visus attiecīgos pasākumus tās jurisdikcijā, lai likvidētu visa
7veida diskrimināciju vai negodīgu konkurences praksi, kas
8negatīvi ietekmē otras Līgumslēdzējas Puses aviokompāniju
9konkurētspēju.
1Komercdarbība
21. Katras Līgumslēdzējas Puses nozīmētajai aviokompānijai vai
3aviokompānijām ir tiesības otras Līgumslēdzējas Puses teritorijā
4saskaņā ar tajā spēkā esošajiem normatīvajiem aktiem uzturēt
5tādus birojus un administratīvo, komerciālo un tehnisko
6personālu, kāds var būt nepieciešams attiecīgās nozīmētās
7aviokompānijas vajadzībām.
82. Uz 1. daļā minēto biroju iekārtošanu un personāla
9nodarbināšanu attiecas konkrētās Līgumslēdzējas Puses
10piemērojamie normatīvie akti, piemēram, normatīvie akti attiecībā
11uz ārzemnieku uzņemšanu un uzturēšanos attiecīgās Līgumslēdzējas
12Puses teritorijā. Darbiniekiem, kas nodarbināti birojos saskaņā
13ar šā panta 1. daļu, piešķir nepieciešamās darba atļaujas pēc
14pieprasījuma neatkarīgi no darba tirgus situācijas un
15attīstības.
163. Līgumslēdzēju Pušu nozīmētās aviokompānijas var brīvi
17pārdot gaisa transporta pakalpojumus ar saviem pārvadājumu
18dokumentiem abu Līgumslēdzēju Pušu teritorijās vai nu tieši, vai
19ar aģenta starpniecību valsts valūtā. Katra Līgumslēdzēja Puse
20atturas ierobežot otras Līgumslēdzējas Puses nozīmētās
21aviokompānijas vai aviokompāniju tiesības pārdot un jebkuras
22personas tiesības iegādāties šādu pārvadājumu.
1Nodokļu uzlikšana un līdzekļu pārskaitīšana
21. Katra Līgumslēdzēja Puse atļauj Līgumslēdzējas Puses
3nozīmētajām aviokompānijām:
4a) iesaistīties gaisa pārvadājumu pārdošanā tās teritorijā
5tieši vai pēc nozīmēto aviokompāniju ieskatiem ar to aģentu
6starpniecību, un pārdot pārvadājumus šīs teritorijas valūtā vai
7pēc nozīmēto aviokompāniju ieskatiem brīvi konvertējamās valūtās,
8kuras akceptē šīs aviokompānijas;
9b) pēc pieprasījuma konvertēt un pārskaitīt uz ārvalstīm
10līdzekļus, kas iegūti to darbības normālā gaitā. Konvertēšana un
11pārskaitīšana ir atļauta bez ierobežojumiem vai kavēšanās saskaņā
12ar ārvalstu valūtas tirgus kursu, kas ir spēkā aktuālo maksājumu
13laikā, kad tiek iesniegts pārveduma pieprasījums, un uz to
14neattiecas nekādas maksas, izņemot parastās pakalpojumu maksas,
15ko bankas iekasē par šiem darījumiem; un
16c) segt vietējos izdevumus, ieskaitot degvielas iegādi, tās
17teritorijā vietējā valūtā, vai pēc nozīmēto aviokompāniju
18ieskatiem, brīvi konvertējamās valūtās ievērojot katras
19Līgumslēdzējas Puses valsts normatīvos aktus vai līgumu
20noteikumus.
212. Ja Līgumslēdzējas Puses ir noslēgušas īpašu līgumu par
22nodokļu dubultās uzlikšanas novēršanu attiecībā uz ienākuma un
23kapitāla nodokļiem, noteicošie ir šī īpašā līguma noteikumi.
1Apkalpošana uz zemes
21. Katra Līgumslēdzēja Puse atļauj otras Līgumslēdzējas Puses
3nozīmētajām aviokompānijām, veicot lidojumus tās teritorijā,
4pamatojoties uz savstarpīgumu, un, ja tas ir iespējams, veikt
5savu apkalpošanu uz zemes ("pašapkalpošanos") un pēc
6savas izvēles nodrošināt, lai visus vai daļu no šiem
7pakalpojumiem sniegtu viens vai vairāki attiecīgi pilnvaroti
8piegādātāji. Ja katras Līgumslēdzējas Puses normatīvie akti vai
9līgumu noteikumi ierobežo vai nepieļauj pašapkalpošanos, katra
10Līgumslēdzēja Puse pret nozīmēto aviokompāniju izturas
11nediskriminējoši attiecībā uz apkalpošanas uz zemes
12pakalpojumiem, ko sniedz viens vai vairāki attiecīgi pilnvaroti
13piegādātāji.
142. Uz 1. daļā paredzēto tiesību izmantošanu attiecas
15tikai fiziskie vai ekspluatācijas ierobežojumi, kas izriet no
16apsvērumiem par lidojumu vai aviācijas drošību lidostā.
1Aviācijas drošība
21. Saskaņā ar starptautisko tiesību normām un no tām
3izrietošajām tiesībām un pienākumiem Līgumslēdzējas Puses
4apliecina, ka šā Nolīguma neatņemama sastāvdaļa ir to
5savstarpējais pienākums aizsargāt civilās aviācijas drošību pret
6nelikumīgas iejaukšanās aktiem. Neierobežojot starptautisko
7tiesību normu un no tām izrietošo tiesību un pienākumu vispārējo
8raksturu, Līgumslēdzējas Puses darbojas saskaņā ar Konvenciju par
9noziegumiem un dažām citām nelikumīgām darbībām, kas izdarītas
10gaisa kuģos, kura parakstīta 1963. gada 14. septembrī
11Tokijā, Konvenciju par cīņu pret nelikumīgu gaisa kuģu
12sagrābšanu, kura parakstīta 1970. gada 16. decembrī Hāgā, un
13Konvenciju par cīņu pret nelikumīgām darbībām, kas apdraud
14civilās aviācijas drošību, kura parakstīta 1971. gada 23.
15septembrī Monreālā, un Protokolu par cīņu pret nelikumīgu
16vardarbību lidostās, kas apkalpo starptautisko civilo aviāciju,
17kas parakstīts 1988. gada 24. februārī Monreālā, Konvenciju par
18plastikas sprāgstvielu marķēšanu, lai veicinātu to atklāšanu,
19kura parakstīta 1991. gada 1. martā Monreālā, vai
20jebkuru citu aviācijas drošības konvenciju, kuru abas
21Līgumslēdzējas Puses var apņemties ievērot.
222. Līgumslēdzējas Puses pēc pieprasījuma sniedz viena otrai
23visu nepieciešamo palīdzību, lai novērstu nelikumīgu civilās
24aviācijas gaisa kuģu sagrābšanu un citas pret gaisa kuģiem, to
25pasažieriem un apkalpēm, lidostām un aeronavigācijas iekārtām
26vērstas nelikumīgas darbības un jebkurus citus draudus civilās
27aviācijas drošībai.
283. Līgumslēdzējas Puses darbojas saskaņā ar aviācijas drošības
29noteikumiem un tehniskajām prasībām, ko noteikusi Starptautiskā
30civilās aviācijas organizācija un kas kā pielikumi pievienoti
31Konvencijai, ciktāl šie drošības noteikumi un prasības ir
32piemērojami Līgumslēdzējām Pusēm; tās pieprasa, lai to reģistra
33gaisa kuģu ekspluatanti vai tie gaisa kuģu ekspluatanti, kuru
34galvenā uzņēmējdarbības vieta vai pastāvīgā dzīvesvieta ir to
35teritorijā, darbotos saskaņā ar šādiem aviācijas drošības
36noteikumiem.
374. Katra Līgumslēdzēja Puse piekrīt, ka šādiem gaisa kuģu
38ekspluatantiem var pieprasīt ievērot 3. daļā minētos
39aviācijas drošības noteikumus un prasības, ko otra Līgumslēdzēja
40Puse pieprasa ievērot ierodoties, izlidojot vai atrodoties tās
41teritorijā, tostarp, Latvijas Republikas gadījumā, Eiropas
42Savienības tiesību aktus. Piemērojamo normatīvo aktu ietvaros
43katra Līgumslēdzēja Puse nodrošina, lai tās teritorijā efektīvi
44tiek veikti atbilstoši pasākumi gaisa kuģu aizsardzībai un
45pasažieru, apkalpes, pasažieriem klātesošās bagāžas, bagāžas,
46kravas un gaisa kuģa krājumu pārbaudei pirms iekāpšanas vai
47iekraušanas gaisa kuģī vai tās laikā. Katra Līgumslēdzēja Puse ar
48sapratni izvērtē jebkuru otras Līgumslēdzējas Puses lūgumu pēc
49saprātīgiem drošības pasākumiem, lai novērstu īpašus draudus.
505. Nelikumīga gaisa kuģa sagrābšanas incidenta vai tā draudu
51gadījumā, vai, ja tiek veiktas citas nelikumīgas pret gaisa kuģa,
52tā pasažieru un apkalpes, lidostu vai aeronavigācijas iekārtu
53drošību vērstas darbības, Līgumslēdzējas Puses palīdz viena
54otrai, veicinot saziņu un veicot citus atbilstošus pasākumus, lai
55ātri un droši izbeigtu šo incidentu vai novērstu tā draudus.
566. Ja viena Līgumslēdzēja Puse pārkāpj šajā pantā noteiktās
57aviācijas drošības prasības, otras Līgumslēdzējas Puses aviācijas
58institūcijas var pieprasīt tūlītējas konsultācijas ar pirmās
59Līgumslēdzējas Puses aviācijas institūcijām. Ja viena mēneša
60laikā pēc šādu konsultāciju pieprasīšanas netiek panākta
61pieņemama vienošanās, tas ir pamats pirmās Līgumslēdzējas Puses
62nozīmētās aviokompānijas vai aviokompāniju pārvadājumu atļaujas
63apturēšanai, atcelšanai, ierobežošanai vai nosacījumu
64piemērošanai. Īpašas nepieciešamības gadījumā jebkura
65Līgumslēdzēja Puse var veikt pagaidu darbības pirms mēneša
66beigām.
1Lidojumu drošība
21. Katra Līgumslēdzēja Puse jebkurā laikā var pieprasīt
3konsultācijas par otras Līgumslēdzējas Puses pieņemtajiem
4lidojumu drošības standartiem visās jomās, kas attiecas uz
5lidojuma apkalpi, gaisa kuģi vai tā izmantošanu. Šīs
6konsultācijas sākas trīsdesmit (30) dienu laikā pēc pieprasījuma
7iesniegšanas.
82. Ja pēc minētajām konsultācijām viena Līgumslēdzēja Puse
9konstatē, ka otra Līgumslēdzēja Puse kādā no jomām neefektīvi
10ievēro un nepilda lidojumu drošības standartus, kas izstrādāti
11atbilstoši Konvencijā noteiktajiem aktuālajiem minimālajiem
12standartiem, tā paziņo otrai Līgumslēdzējai Pusei par iegūto
13informāciju un pasākumiem, kas jāveic, lai nodrošinātu atbilstību
14šiem minimālajiem standartiem, un šī otra Līgumslēdzēja Puse veic
15atbilstošus pasākumus. Ja otra Līgumslēdzēja Puse neveic
16atbilstošus pasākumus piecpadsmit (15) dienu laikā vai ilgākā
17laika periodā, ja par to panākta vienošanās, tiek piemēroti šā
18Nolīguma 5. panta noteikumi.
193. Neatkarīgi no Konvencijas 33. pantā minētajiem pienākumiem,
20ir panākta vienošanās, ka jebkuru gaisa kuģi, ko ekspluatē vienas
21Līgumslēdzējas Puses nozīmētā aviokompānija vai aviokompānijas,
22vai saskaņā ar nomas līgumu to ekspluatē vienas Līgumslēdzējas
23Puses nozīmētās aviokompānijas vai aviokompāniju vārdā,
24pakalpojumiem uz citas Līgumslēdzējas Puses teritoriju vai no
25tās, var, tam atrodoties otras Līgumslēdzējas Puses teritorijā,
26pārbaudīt otras Līgumslēdzējas Puses pilnvarotie pārstāvji no
27iekšpuses un ārpuses, lai pārbaudītu gan gaisa kuģa, gan tā
28apkalpes dokumentu derīgumu, un vizuālo gaisa kuģa un tā
29aprīkojuma stāvokli (šajā pantā dēvēta "gaisa kuģa
30pārbaude"), ja vien tas neizraisa nepamatotu
31aizkavēšanos.
324. Ja jebkuras šādas gaisa kuģa pārbaudes vai pārbaužu sērijas
33rezultātā rodas:
34a) pamatotas aizdomas, ka gaisa kuģis vai šā gaisa kuģa
35izmantošana neatbilst Konvencijā noteiktajiem aktuālajiem
36minimālajiem standartiem, vai
37b) nopietnas bažas par to, ka trūkst efektīvas Konvencijā
38noteikto aktuālo drošības standartu uzturēšanas un
39administrēšanas,
40Līgumslēdzējas Puses kompetentā institūcija, kas veikusi
41pārbaudi, atbilstoši Konvencijas 33. panta noteikumiem var
42secināt, ka prasības, saskaņā ar kurām apliecība vai licences
43attiecībā uz šo gaisa kuģi vai tā apkalpi izsniegtas vai atzītas
44par derīgām, vai prasības, saskaņā ar kurām gaisa kuģis veic
45lidojumus, neatbilst vai ir zemākas par Konvencijā noteiktajiem
46minimālajiem standartiem.
475. Ja vienas Līgumslēdzējas Puses nozīmētās aviokompānijas vai
48aviokompāniju pārstāvis aizliedz piekļūt gaisa kuģim, kuru
49konkrētā aviokompānija izmanto, vai tas tiek izmantots tās vārdā,
50lai veiktu gaisa kuģa pārbaudi saskaņā ar šā panta 3. daļu,
51otra Līgumslēdzēja Puse var konstatēt, ka tas izraisa nopietnas
52aizdomas par šā panta 4. daļā minētajiem pārkāpumiem, un
53izdarīt šajā daļā minētos secinājumus.
546. Katras Līgumslēdzējas Puses aviācijas institūcija saglabā
55tiesības nekavējoties apturēt vai mainīt otras Līgumslēdzējas
56Puses nozīmētās aviokompānijas vai aviokompāniju pārvadājumu
57atļaujas, ja aviācijas institūcija pēc gaisa kuģa pārbaudes,
58gaisa kuģa pārbaužu sērijas, aizlieguma veikt gaisa kuģa
59pārbaudi, konsultācijām vai citādi konstatē, ka nekavējoties
60jāveic pasākumi, lai nodrošinātu aviokompānijas veiktās satiksmes
61drošību.
627. Katra Līgumslēdzēja Puse pārtrauc veikt pasākumus, kas
63noteikti šā panta 2. vai 6. daļā, ja ir novērsts to iemesls.
1Normatīvo aktu piemērošana
21. Vienas Līgumslēdzējas Puses normatīvos aktus, kas regulē
3starptautiskās satiksmes gaisa kuģa ierašanos tās teritorijā, šīs
4teritorijas atstāšanu vai šā gaisa kuģa izmantošanu un navigāciju
5minētajā teritorijā, piemēro otras Līgumslēdzējas Puses
6nozīmētajai aviokompānijai vai aviokompānijām.
72. Vienas Līgumslēdzējas Puses normatīvos aktus, kuri regulē
8pasažieru, apkalpes, kravas vai pasta ierašanos tās teritorijā,
9uzturēšanos tajā vai tās atstāšanu, piemēram, ieceļošanas,
10izceļošanas, emigrācijas, imigrācijas, muitas, valūtas, veselības
11un karantīnas formalitātes, piemēro otras Līgumslēdzējas Puses
12nozīmētās aviokompānijas vai aviokompāniju pārvadātajiem
13pasažieriem, apkalpēm, kravām un pastam, tiem atrodoties šajā
14teritorijā.
153. Pasažieriem, bagāžai un kravai, kas tiešā tranzītā šķērso
16kādas Līgumslēdzējas Puses teritoriju un nepamet šim nolūkam
17paredzēto lidostas teritoriju, piemēro tikai vienkāršotu
18kontroli, izņemot ja tas attiecas uz drošības pasākumiem pret
19vardarbības aktiem, gaisa pirātismu, kā arī narkotisko vielu
20kontrabandu.
214. Gadījumā, ja pārvadātais pasažieris neievēro piemērojamos
22normatīvos aktus, kas attiecas uz ieceļošanu otras Līgumslēdzējas
23Puses valstī, aviokompānijai ir pienākums nogādāt viņu atpakaļ
24par šīs aviokompānijas izmaksām.
1Piemērojamība čartera / neregulārajiem lidojumiem
21. Noteikumi, kas izklāstīti 6. pantā (Nediskriminācija
3attiecībā uz maksām), 10. pantā (Informācija un statistika), 14.
4pantā (Nodokļu uzlikšana un līdzekļu pārskaitīšana), 15. pantā
5(Apkalpošana uz zemes), 16. pantā (Aviācijas drošība), 17. pantā
6(Lidojumu drošība), 18. pantā (Normatīvo aktu piemērošana), un
720. pantā (Konsultācijas) attiecas arī uz čartera lidojumiem un
8citiem neregulārajiem lidojumiem, ko veic vienas Līgumslēdzējas
9Puses gaisa pārvadātāji uz otras Līgumslēdzējas Puses teritoriju
10vai no tās.
112. 1. daļa neietekmē valstu normatīvos aktus, kas
12reglamentē čartera lidojumu vai neregulāro lidojumu atļaušanu vai
13gaisa pārvadātāju vai citu iesaistīto pušu rīcību.
1Konsultācijas
2Jebkura Līgumslēdzēja Puse var jebkurā laikā pieprasīt
3konsultācijas par šā Nolīguma īstenošanu, interpretāciju,
4piemērošanu vai grozīšanu, vai atbilstību šim Nolīgumam. Šīs
5konsultācijas, kas var notikt starp Līgumslēdzēju Pušu aviācijas
6institūcijām, sākas sešdesmit (60) dienu laikā no dienas, kad
7otra Līgumslēdzēja Puse saņem rakstisku pieprasījumu, ja vien
8Līgumslēdzējas Puses savstarpēji neizlemj citādi vai ja šajā
9Nolīgumā nav noteikts citādi.
1Strīdu izšķiršana
21. Ja starp Līgumslēdzējām Pusēm rodas jebkāds strīds par šā
3Nolīguma interpretāciju vai piemērošanu, Līgumslēdzējas Puses
4vispirms to cenšas nokārtot sarunu ceļā saskaņā ar 20. pantā
5noteikto kārtību.
62. Ja Līgumslēdzējas Puses nevar strīdu nokārtot sarunu ceļā,
7tās var vienoties nodot strīdu izšķiršanai kādai personai vai
8institūcijai; ja tās nespēj vienoties, strīdu pēc jebkuras
9Līgumslēdzējas Puses pieprasījuma iesniedz izšķiršanai triju
10tiesnešu šķīrējtiesai, kurai katra Līgumslēdzēja Puse apstiprina
11vienu tiesnesi un trešo tiesnesi ieceļ abi jau apstiprinātie
12tiesneši. Katra Līgumslēdzēja Puse savu tiesnesi apstiprina
13sešdesmit (60) dienu laikā pēc tam, kad diplomātiskā ceļā ir
14saņēmusi otras Līgumslēdzējas Puses pieprasījumu par strīda
15izšķiršanu šķīrējtiesā, un trešais tiesnesis tiek iecelts
16sešdesmit (60) dienu laikā pēc minēto tiesnešu
17apstiprināšanas.
18Ja kāda no Līgumslēdzējām Pusēm noteiktajā laikā neapstiprina
19savu tiesnesi, Starptautiskās civilās aviācijas organizācijas
20Padomes prezidents pēc jebkuras Līgumslēdzējas Puses pieprasījuma
21var iecelt nepieciešamo tiesnesi vai tiesnešus. Jebkurā gadījumā
22trešais tiesnesis ir trešās valsts pilsonis un veic šķīrējtiesas
23priekšsēdētāja pienākumus. Šķīrējtiesa pieņem lēmumu ar balsu
24vairākumu. Visos pārējos jautājumos šķīrējtiesa pati nosaka savu
25darbības kārtību.
263. Līgumslēdzējas Puses apņemas pildīt jebkurus lēmumus, kas
27pieņemti saskaņā ar šā panta 2. daļu.
284. Ja viena Līgumslēdzēja Puse nepilda lēmumu, kas pieņemts
29saskaņā ar šā panta 2. daļu, otra Līgumslēdzēja Puse var
30ierobežot, apturēt vai atsaukt jebkuras tiesības vai
31privilēģijas, ko saskaņā ar šo Nolīgumu tā piešķīrusi saistības
32nepildošajai Līgumslēdzējai Pusei.
335. Katra Līgumslēdzēja Puse sedz sava šķīrējtiesneša izdevumus
34un maksā viņam atlīdzību; naudas summas, kas veido atlīdzību
35trešajam tiesnesim, un ar trešā tiesneša un šķīrējtiesas darbību
36saistītos izdevumus vienlīdzīgās daļās sedz abas Līgumslēdzējas
37Puses.
1Grozījumi
21. Ja kāda no Līgumslēdzējām Pusēm vēlas grozīt kādu šā
3Nolīguma noteikumu, ieskaitot pielikumu, tas notiek pēc
4konsultācijām saskaņā ar šā Nolīguma 20. pantu.
52. Šo Nolīgumu un tā pielikumu var grozīt un papildināt, abām
6Līgumslēdzējām Pusēm savstarpēji vienojoties. Šādus grozījumus un
7papildinājumus izdara atsevišķu protokolu veidā, kas ir šā
8Nolīguma neatņemama sastāvdaļa, un tie stājas spēkā saskaņā ar šā
9Nolīguma 25. panta noteikumiem.
1Izbeigšana
2Katra Līgumslēdzēja Puse jebkurā laikā var rakstveidā pa
3diplomātiskajiem kanāliem paziņot otrai Līgumslēdzējai Pusei par
4savu lēmumu izbeigt šo Nolīgumu. Šo paziņojumu vienlaikus nosūta
5Starptautiskajai civilās aviācijas organizācijai. Šis Nolīgums
6tiek pārtraukts pusnaktī (pēc tās Līgumslēdzējas Puses vietējā
7laika, kura ir saņēmusi paziņojumu) divpadsmit (12) mēnešus pēc
8dienas, kad otra Līgumslēdzēja Puse saņēmusi paziņojumu, ja vien
9minētais paziņojums netiek atcelts ar vienošanos pirms šā perioda
10beigām. Ja otra Līgumslēdzēja Puse neapliecina, ka tā saņēmusi
11paziņojumu, paziņojumu uzskata par saņemtu četrpadsmit (14)
12dienas pēc tam, kad to saņēmusi Starptautiskā civilās aviācijas
13organizācija.
1Stāšanās spēkā
2Šis Nolīgums stājas spēkā dienā, kad ir saņemts vēlākais no
3paziņojumiem, ar kuriem abas Līgumslēdzējas Puses pa
4diplomātiskajiem kanāliem ir paziņojušas viena otrai par to, ka
5saskaņā ar to attiecīgajām iekšējām procedūrām ir izpildītas
6prasības, lai Nolīgums stātos spēkā.
7Parakstīts Kualalumpurā, Malaizijā, 2024. gada
822. oktobrī trīs oriģināleksemplāros, latviešu, spāņu un
9angļu valodās. Visi teksti ir vienlīdz autentiski. Atšķirīgas
10interpretācijas gadījumā noteicošais ir teksts angļu valodā.

65aviokompānijām ir atļautas abpusēji, veicot tikai un vienīgi

76- trešās valsts aviokompāniju vai aviokompānijām ar noteikumu,
77ka šāda trešā valsts pilnvaro vai atļauj līdzvērtīgas vienošanās
78starp otras Līgumslēdzējas Puses aviokompānijām un citām
79aviokompānijām par pakalpojumiem uz šādu trešo valsti, no tās un

98The Government of the Republic of Latvia and the Government of
99the Dominican Republic, hereinafter referred to as "the
100Contracting Parties";
101Being Parties to the Convention on International Civil
102Aviation opened for signature at Chicago on 7 December 1944;
103Desiring to conclude an Agreement in conformity with and
104supplementary to the said Convention for the purpose of
105establishing air services between and beyond their respective
106territories of each state based on the principle of
107reciprocity,
108Have agreed as follows:
109Article 1
110Definitions
1111. For the purposes of this Agreement, unless the context
112otherwise requires:
113a) the term "Convention" means the Convention
114on International Civil Aviation opened for signature at Chicago
115on 7 December 1944, and includes any Annex adopted under Article
11690 of that Convention and any amendment of the Annexes and
117Convention adopted under Articles 90 and 94 thereof so far as
118those Annexes and amendments have become effective for or have
119been ratified in the states of both Contracting Parties;
120b) the term "aeronautical authorities" means,
121in the case of the Republic of Latvia, the Ministry of Transport,
122and in the case of the Dominican Republic, the Civil Aviation
123Board or, in both cases, any other person or body authorized to
124perform any functions at present exercised by the said
125aeronautical authorities;
126c) the term "designated airline" means an
127airline which has been designated and authorized in accordance
128with Article 4 of this Agreement;
129d) the term "territory" in relation to the
130Contracting Parties is understood as the territory of the
131Republic of Latvia or the territory of the Dominican Republic, as
132the context requires, and has the meaning assigned to it in
133Article 2 of the Convention; and shall read as follow: "For
134the purposes of this Convention the territory of a State shall be
135deemed to be the land areas and territorial waters adjacent
136thereto under the sovereignty, suzerainty, protection or mandate
137of such State";
138e) the term "sovereignty" for the
139purpose of this Agreement shall have the meaning assigned to it
140in Article 1 of the Convention, and shall read as follows:
141"The contracting States recognize that every State has
142complete and exclusive sovereignty over the airspace above its
143territory";
144f) the terms "air service", "international
145air service", "airline" and "stop
146for non-traffic purposes" have the meanings assigned
147to them in Article 96 of the Convention;
148g) the term "prices" means the prices to be
149charged for the carriage of passengers, baggage or cargo
150(excluding mail), including any significant additional benefits
151to be furnished or made available in conjunction with such
152carriage, and the commission to be paid on the sales of tickets
153for the carriage of persons, or on corresponding transactions for
154the carriage of cargo. It includes also the conditions that
155govern the applicability of the price for carriage or the payment
156of commission;
157h) the term "Annex" means the Annex to this
158Agreement. The Annex forms an integral part of this Agreement and
159all references to this Agreement shall include also references to
160the Annex except where explicitly agreed otherwise;
161i) the term "EU Treaties" shall mean the
162Treaty on European Union and the Treaty on the functioning of the
163European Union.
1642. Titles given to the Articles of this Agreement are for
165reference purposes only.
1663. References in this Agreement to nationals of the Republic
167of Latvia shall be understood as referring to nationals of the
168European Union Member States. References in this Agreement to
169airline or airlines of the Republic of Latvia shall be understood
170as referring to airline or airlines designated by the Republic of
171Latvia.
172Article 2
173Grant of Traffic Rights
1741. Each Contracting Party grants to the other Contracting
175Party the following rights in respect of the international air
176services:
177a) the right to fly across its territory without landing;
178b) the right to make stops in its territory for non-traffic
179purposes.
1802. Each Contracting Party grants to the other Contracting
181Party the rights specified in this Agreement for the purpose of
182operating international air services on the routes specified in
183the Annex to this Agreement. Such services and routes are
184hereinafter called "the agreed services" and
185"the specified routes" respectively. While
186operating an agreed service on a specified route the airline or
187airlines designated by each Contracting Party shall enjoy, in
188addition to the rights specified in paragraph 1 of this Article,
189the right to make stops in the territory of the other Contracting
190Party at the points specified for that route in the Annex for the
191purpose of taking on and/or discharging international traffic in
192passengers, baggage, cargo and mail, separately or in combination
193on a commercial basis.
1943. Nothing in paragraph 2 of this Article shall be deemed to
195confer on a designated airline of one Contracting Party the right
196of taking on board, in the territory of the other Contracting
197Party, passengers, cargo and mail carried for remuneration or
198hire and destined for another point in the territory of that
199other Contracting Party (cabotage).
2004. If because of armed conflict, political disturbances or
201developments, or special and unusual circumstances, a designated
202airline of one Contracting Party is unable to operate a service
203on its normal routing, the other Contracting Party shall use its
204best efforts to facilitate the continued operation of such
205service through appropriate temporary rearrangements of
206routes.
207Article 3
208Recognition of Certificates and Licences
2091. Certificate of airworthiness, certificates of competency
210and licences issued or rendered valid by competent authority one
211of the Contracting Parties shall, during the period of their
212validity, be recognized as valid by the other Contracting Party,
213provided that the requirements under which such certificates or
214licences were issued or rendered valid are equal to or above the
215minimum standards which may be established pursuant to the
216Convention.
2172. Each Contracting Party reserves the right, however, to
218refuse to recognize as valid, for the purpose of flights over its
219own territory, certificate of competency and licences granted to
220or rendered valid for its own states' nationals by the other
221Contracting Party or by any other State.
222Article 4
223Designation of Airlines and Operating Authorization
2241. Each Contracting Party shall have the right to designate in
225writing through the diplomatic channels to the other Contracting
226Party one or several airlines for the purpose of operating the
227agreed services on the specified routes.
2282. Each Contracting Party shall have the right to withdraw or
229alter such designation by written notification to other
230Contracting Party.
2313. On receipt of such a designation the other Contracting
232Party shall grant the appropriate authorisations and permissions
233with minimum procedural delay, provided:
234a) in the case of an airline designated by the Republic of
235Latvia:
236i) it is established in the territory of the Republic of
237Latvia under the EU Treaties and has a valid Operating Licence in
238accordance with European Union law; and
239ii) effective regulatory control of the airline is exercised
240and maintained by the European Union Member State responsible for
241issuing its Air Operator's Certificate and the relevant
242aeronautical authority is clearly identified in the designation;
243and
244iii) the airline is owned, directly or through majority
245ownership, and it is effectively controlled by the European Union
246Member States or the European Free Trade Association Member
247States and/or by nationals of such states;
248b) in the case of an airline designated by the Dominican
249Republic:
250i) it is established, constituted, and licensed under the
251applicable laws and regulations of the Dominican Republic with a
252principal place of business in its national territory; and
253ii) effective regulatory control of the airline is exercised
254and maintained by the Dominican Republic responsible for issuing
255its Air Operator's Certificate and the relevant aeronautical
256authority is clearly identified in the designation; and
257c) the aeronautical authorities of one Contracting Party may
258require an airline designated by the other Contracting Party to
259satisfy them that it is qualified to fulfil the conditions
260prescribed under the laws and regulations normally and reasonably
261applied to the operation of international air services by such
262authorities in conformity with the provisions of the
263Convention.
264d) the Contracting Party designating the airline is in
265compliance with the provisions set forth in Article 16 and
266Article 17 of this Agreement; and
2674. When an airline has been so designated and authorized it
268may begin at any time to operate the agreed services, provided
269that the airline complies with all applicable provisions of this
270Agreement, including those relating to prices.
271Article 5
272Refusal, revocation or suspension of operating authorization
2731. Either aeronautical authority of Contracting Party may
274revoke, suspend or limit the operating authorisation or technical
275permissions of an airline designated by the other Contracting
276Party where:
277a) in the case of an airline designated by the Republic of
278Latvia:
279i) it is not established in the territory of the Republic of
280Latvia under the EU Treaties or does not have a valid Operating
281Licence in accordance with European Union law; or
282ii) effective regulatory control of the airline is not
283exercised or not maintained by the European Union Member State
284responsible for issuing its Air Operator's Certificate, or the
285relevant aeronautical authority is not clearly identified in the
286designation, or
287iii) the airline is not owned, directly or through majority
288ownership, or it is not effectively controlled by the European
289Union Member States or the European Free Trade Association Member
290States and/or by nationals of such states;
291b) in the case of an airline designated by the Dominican
292Republic:
293i) it is not established, constituted, and licensed under the
294applicable laws and regulations of the Dominican Republic with a
295principal place of business in its national territory; or
296ii) effective regulatory control of the airline is not
297exercised and maintained by the Dominican Republic responsible
298for issuing its Air Operator's Certificate or the relevant
299aeronautical authority is not clearly identified in the
300designation; or
301c) in the case of failure by that airline to comply with the
302applicable laws and regulations of the Contracting Party granting
303these rights, or
304d) in any case in which that airline otherwise fails to
305operate the agreed services in accordance with the conditions
306prescribed under this Agreement, or
307e) in the case of failure by the other Contracting Party to
308comply with or apply the Security and Safety standards in
309accordance with Articles 16 and 17 of this Agreement.
3102. Unless immediate revocation, suspension or imposition of
311the conditions mentioned in paragraph 1 of this Article is
312essential to prevent further infringements of laws and
313regulations, such right shall be exercised only after
314consultations with the aeronautical authorities of the other
315Contracting Party. Such consultations shall begin within a period
316of thirty (30) days from the date of a request for
317consultations.
318Article 6
319Non-discrimination in respect of charges
320Each Contracting Party shall ensure that charges that may be
321imposed by its competent charging authorities or bodies on the
322airlines of the other Contracting Party for the use of air
323navigation and air traffic control services, airport, aviation
324security and related facilities and services shall be set in
325accordance with the laws and regulations of each Contracting
326Party and shall not be unjustly discriminatory. In any event, any
327such charges shall be assessed on the airlines of the other
328Contracting Party on terms no less favourable than the most
329favourable terms available to any other airline.
330Article 7
331Exemption from customs and other duties
3321. Aircraft operated on international air services by a
333designated airline of one Contracting Party, as well as their
334regular equipment, spare parts, supplies of fuel and lubricants,
335aircraft stores (including food, beverages and tobacco) on board
336such aircraft shall be exempted, on the basis of reciprocity,
337from all customs duties, inspection fees and other similar
338charges on arriving in the territory of the other Contracting
339Party, in accordance with the provisions of the laws and
340regulations in force of each Contracting Party, provided such
341equipment, spare parts, supplies and stores remain on board the
342aircraft up to such time as they are re-exported or are used or
343consumed by such aircraft on flights over that territory.
3442. There shall also be exempt from the duties, fees and
345charges referred to in paragraph 1 of this Article, with the
346exception of charges based on the cost of the service
347provided:
348a) aircraft stores taken on board in the territory of one
349Contracting Party within reasonable limits, for use on an
350outbound aircraft engaged in an international air service of a
351designated airline of the other Contracting Party;
352b) spare parts, including engines, introduced into the
353territory of one Contracting Party for the maintenance or repair
354of aircraft engaged in an international air service of a
355designated airline of the other Contracting Party;
356c) fuel, lubricants and consumable technical supplies
357introduced into or supplied in the territory of one Contracting
358Party for use in an international air service of a designated
359airline of the other Contracting Party, even when these supplies
360are to be used on the part of the journey performed over the
361territory of the other Contracting Party, in which territory they
362are taken on board.
3633. Materials referred to in paragraph 2 of this Article may be
364required to be kept under Customs supervision or control.
3654. The regular airborne equipment, as well as the materials,
366supplies and spare parts normally retained on board aircraft
367operated by a designated airline of one Contracting Party, may be
368unloaded in the territory of the other Contracting Party only
369with the approval of the customs authorities of that Contracting
370Party. In such case, they may be placed under the supervision of
371the said authorities up to such time as they are re-exported or
372otherwise disposed of in accordance with customs regulations.
3735. Necessary documents, such as timetables, air tickets and
374air waybills, intended for the use of a designated airline of one
375Contracting Party and introduced into the territory of the other
376Contracting Party, shall be exempted from customs duties and
377taxes in the latter territory.
3786. Baggage and cargo in direct transit across the territory of
379a Contracting Party shall be exempted from customs duties, fees
380and other similar charges not based on the cost of services on
381arrival or departure.
382Article 8
383Capacity provisions
3841. The designated airlines of the Contracting Parties shall
385have fair and equal opportunity to operate the agreed services on
386any route specified in the Annex to this Agreement.
3872. In operating the agreed services the designated airline or
388airlines of each Contracting Party shall take into account the
389interests of the designated airline or airlines of the other
390Contracting Party so as not to affect unduly the services which
391the latter provide on the whole or any part of the same
392routes.
3933. The agreed services provided by the designated airlines of
394the Contracting Parties shall retain as their primary objective
395the provision, at a reasonable load factor, of capacity adequate
396to the current and reasonably anticipated requirements for the
397carriage of passengers and cargo, including mail, coming from or
398destined for the territory of the Contracting Party which has
399designated the airline or airlines.
4004. The right to take up or discharge on the agreed services
401international traffic destined for and coming from third
402countries at a point or points on the routes specified in the
403Annex to this Agreement shall be exercised in accordance with the
404general principles of orderly development of international air
405transport and shall be subject to the general principle that
406capacity should be related to:
407a) the traffic requirements between the country of origin and
408the countries of ultimate destination of the traffic; and
409b) the requirements of through airline operations; and
410c) the traffic requirements of the area through which the
411airline passes, after taking account of local and regional air
412services.
413Article 9
414Approval of traffic programmes
4151. The airline or airlines designated by one Contracting Party
416shall coordinate between them if one Contracting Party requires
417to submit its or their traffic programmes (for the Summer and
418Winter Traffic periods) for registration to the aeronautical
419authorities of the other Contracting Party at least thirty (30)
420days prior to the beginning of the operation. The programme shall
421include in particular the timetables, the frequency of the
422services and the types of aircraft to be used. The aeronautical
423authorities shall, if it is applicable, give their decision on
424such traffic programme submissions within twenty (20) days from
425the date the airline concerned submits its programme for
426approval.
4272. Each alteration in the traffic programme as well as
428requests for permission to operate additional flights shall be
429submitted by the airline or airlines designated by one
430Contracting Party for approval to the aeronautical authorities of
431the other Contracting Party. Such requests for alteration or for
432additional flights shall be dealt with promptly by the
433aeronautical authorities.
434Article 10
435Information and statistics
436The aeronautical authorities of either Contracting Party shall
437supply to the aeronautical authorities of the other Contracting
438Party, at their request, such information and statistics relating
439to traffic carried on the agreed services by the designated
440airline or airlines of the first Contracting Party to and from
441the territory of the other Contracting Party as may normally be
442prepared and submitted to its national aeronautical authorities.
443Any additional statistical traffic data which the aeronautical
444authorities of one Contracting Party may desire shall, upon
445request, be a subject of mutual discussion and agreement between
446the aeronautical authorities of the two Contracting Parties.
447Article 11
448Prices
4491. Contracting Parties shall permit prices to be freely
450established by the air carriers on the basis of free and fair
451competition.
4522. Prices for international air transport operated pursuant to
453this Agreement shall not be required to be filed with the
454aeronautical authorities of either Contracting Party.
4553. Without limiting the application of general competition and
456consumer law in each Contracting Party, intervention by the
457Contracting Parties may be initiated to:
458a) prevent unreasonably discriminatory prices or
459practices;
460b) protect consumers from prices that are unreasonably high or
461unreasonably restrictive due either to the abuse of a dominant
462position or to concerted practices among air carriers; and
463c) protect airlines from prices that are artificially low
464because of direct or indirect governmental subsidy or
465support.
466Article 12
467Fair competition
4681. There shall be fair and equal opportunity for the
469designated airlines of both Contracting Parties to participate in
470international air transportation covered by this Agreement.
4712. Each Contracting Party shall, where necessary, take all
472appropriate action within its jurisdiction to eliminate all forms
473of discrimination or unfair competitive practices adversely
474affecting the competitive position of the airlines of the other
475Contracting Party.
476Article 13
477Commercial activities
4781. The designated airline or airlines of each Contracting
479Party shall have the right to maintain in the territory of the
480other Contracting Party, within the scope of the laws and
481regulations in force therein, such offices and administrative,
482commercial and technical personnel as may be necessary for the
483requirements of the designated airline concerned.
4842. The establishment of the offices and the employment of the
485personnel referred to in paragraph 1 shall be subject to the
486applicable laws and regulations of the Contracting Party
487concerned, such as the laws and regulations relating to the
488admission of foreigners and their stay in the territory of the
489Contracting Party concerned. The personnel employed in the
490offices according to paragraph 1 above shall be granted work
491permits upon application, regardless of the situation and the
492development of the labour market.
4933. The designated airlines of the Contracting Parties shall be
494free to sell air transport services on their own transportation
495documents in the territories of both Contracting Parties, either
496directly or through an agent, in the national currency. Each
497Contracting Party shall refrain from restricting the right of the
498designated airline or airlines of the other Contracting Party to
499sell, and of any person to purchase such transportation.
500Article 14
501Taxation and transfer of funds
5021. Each Contracting Party shall permit the designated airlines
503of the Contracting Party:
504a) to engage in the sale of air transportation in its
505territory directly or, at the discretion of the designated
506airlines, through their agents and to sell transportation in the
507currency of that territory or, at the discretion of the
508designated airlines, in freely convertible currencies accepted by
509those airlines;
510b) to convert and remit abroad, on demand, funds obtained in
511the normal course of their operations. The conversion and
512remittance shall be permitted without restrictions or delay at
513the foreign exchange market rates for current payments prevailing
514at the same time of submission of the request for transfer, and
515shall not be subject to any charges except normal service charges
516collected by banks for those transactions; and
517c) to pay local expenses, including purchases of fuel, in its
518territory in local currency, or at the discretion of the
519designated airlines, in freely convertible currencies subject to
520the national laws, regulations or contractual provisions of each
521Contracting Party.
5222. Where a special agreement for avoidance of double taxation
523with respect to taxes on income and capital exists between the
524Contracting Parties, the provisions of this special agreement
525shall prevail.
526Article 15
527Ground Handling
5281. Each Contracting Party shall permit the designated airlines
529of the other Contracting Party when operating in its territory,
530on the basis of reciprocity and where available, to perform their
531own ground handling ("self-handling") and, at their option, to
532have all or part of those services provided by one or more duly
533authorized suppliers. Where the laws, regulations or contractual
534provisions of each Contracting Party limit or preclude
535self-handling, each Contracting Party shall treat a designated
536airline on a non-discriminatory basis regarding ground handling
537services provided by one or more duly authorized providers.
5382. The exercise of the rights provided in paragraph 1 shall be
539subject only to the physical or operational limitations resulting
540from considerations of safety or aviation security at the
541airport.
542Article 16
543Aviation Security
5441. Consistent with their rights and obligations under
545international law, the Contracting Parties reaffirm that their
546obligation to each other to protect the security of civil
547aviation against acts of unlawful interference forms an integral
548part of this Agreement. Without limiting the generality of their
549rights and obligations under international law, the Contracting
550Parties shall in particular act in conformity with the provisions
551of the Convention on Offences and Certain Other Acts Committed on
552Board Aircraft, signed at Tokyo on 14 September 1963, the
553Convention for the Suppression of Unlawful Seizure of Aircraft,
554signed at The Hague on 16 December 1970 and the Convention for
555the Suppression of Unlawful Acts against the Safety of Civil
556Aviation, signed at Montreal on 23 September 1971 and the
557Protocol for the Suppression of Unlawful Acts of Violence at
558Airports Serving International Civil Aviation, signed at Montreal
559on 24 February 1988, Convention on the Marking of
560Plastic Explosives for the Purpose of Detection signed
561at Montreal on 1 March 1991 or any other aviation security
562convention to which the two Contracting Parties may adhere.
5632. The Contracting Parties shall provide upon request all
564necessary assistance to each other to prevent acts of unlawful
565seizure of civil aircraft and other unlawful acts against the
566safety of such aircraft, their passengers and crew, airports and
567air navigation facilities, and any other threat to the security
568of civil aviation.
5693. The Contracting Parties shall act in conformity with the
570aviation security provisions and technical requirements
571established by the International Civil Aviation Organization and
572designated as Annexes to the Convention to the extent that such
573security provisions and requirements are applicable to the
574Contracting Parties; they shall require that operators of
575aircraft of their registry or operators of aircraft who have
576their principal place of business or permanent residence in their
577territory act in conformity with such aviation security
578provisions.
5794. Each Contracting Party agrees that such operators of
580aircraft may be required to observe the aviation security
581provisions and requirements referred to in paragraph 3 above
582required by the other Contracting Party for entry into, departure
583from, or while within the territory of that other Contracting
584Party, including, in the case of the Republic of Latvia, European
585Union law. Under the applicable laws and regulations each
586Contracting Party shall ensure that adequate measures are
587effectively applied within its territory to protect the aircraft
588and to inspect passengers, crew, carry-on items, baggage, cargo
589and aircraft stores prior to and during boarding or loading. Each
590Contracting Party shall also give sympathetic consideration to
591any request from the other Contracting Party for reasonable
592special security measures to meet a particular threat.
5935. When an incident or threat of an incident of unlawful
594seizure of civil aircraft or other unlawful acts against the
595safety of such aircraft, their passengers and crew, airports or
596air navigation facilities occurs, the Contracting Parties shall
597assist each other by facilitating communications and other
598appropriate measures intended to terminate rapidly and safely
599such incident or threat thereof.
6006. Should a Contracting Party depart from the aviation
601security provisions of this Article, the aeronautical authorities
602of the other Contracting Party may request immediate
603consultations with the aeronautical authorities of the former
604Contracting Party. Failure to reach a satisfactory agreement
605within one month of the date of such request shall constitute
606grounds for withholding, revoking, limiting or imposing
607conditions on the operating authorization of an airline or
608airlines of the former Contracting Party. If required by a
609serious emergency, either Contracting Party may take interim
610action prior to the expiry of the month.
611Article 17
612Aviation Safety
6131. Each Contracting Party may request consultations at any
614time concerning safety standards in any area relating to aircrew,
615aircraft or their operation adopted by the other Contracting
616Party. Such consultations shall take place within thirty (30)
617days of that request.
6182. If, following such consultations, one Contracting Party
619finds that the other Contracting Party does not effectively
620maintain and administer safety standards in any such area that
621are at least equal to the minimum standards established at that
622time pursuant to the Convention, the first Contracting Party
623shall notify the other Contracting Party of those findings and
624the steps considered necessary to conform with those minimum
625standards, and that other Contracting Party shall take
626appropriate corrective action. Failure by the other Contracting
627Party to take appropriate action within fifteen (15) days or such
628longer period as may be agreed, shall be grounds for the
629application of Article 5 of this Agreement.
6303. Notwithstanding the obligations mentioned in Article 33 of
631the Convention it is agreed that any aircraft operated by or,
632under the lease agreement, on behalf of the designated airline or
633airlines of one Contracting Party on services to or from the
634territory of another Contracting Party may, while within the
635territory of the other Contracting Party, be made the subject of
636an examination by the authorized representatives of the other
637Contracting Party, on board and around the aircraft to check both
638the validity of the aircraft documents and those of its crew and
639the apparent condition of the aircraft and its equipment (in this
640Article called "ramp inspection"), provided this does
641not lead to unreasonable delay.
6424. If any such ramp inspection or series of ramp inspections
643gives rise to:
644a) serious concerns that an aircraft or the operation of an
645aircraft does not comply with the minimum standards established
646at the time pursuant to the Convention, or
647b) serious concerns that there is a lack of effective
648maintenance and administration of safety standards established at
649that time pursuant to the Convention,
650the competent authority of the Contracting Party carrying out
651the inspection shall, for the purposes of Article 33 of the
652Convention, be free to conclude that the requirements under which
653the certificate or licences in respect of that aircraft or in
654respect of the crew of that aircraft had been issued or rendered
655valid, or that the requirements under which that aircraft is
656operated, are not equal to or above the minimum standards
657established pursuant to the Convention.
6585. In the event that access for the purpose of undertaking a
659ramp inspection of an aircraft operated by, or, on behalf of the
660designated airline of one Contracting Party in accordance with
661paragraph 3 of this Article is denied by the representative of
662that airline or airlines, the other Contracting Party shall be
663free to infer that serious concerns of the type referred to in
664paragraph 4 above arise and draw the conclusions referred to in
665that paragraph.
6666. Each aeronautical authority of Contracting Party reserves
667the right to suspend or vary the operating authorization of a
668designated airline or airlines of the other Contracting Party
669immediately in the event the aeronautical authority concludes,
670whether as a result of a ramp inspection, a series of ramp
671inspections, a denial of access for ramp inspection,
672consultations or otherwise, that immediate action is essential to
673the safety of an airline operation.
6747. Any action by one Contracting Party in accordance with
675paragraph 2 or 6 above shall be discontinued once the basis for
676the taking of that action ceases to exist.
677Article 18
678Application of laws and regulations
6791. The applicable laws and regulations of one Contracting
680Party relating to the entry into, or departure from its territory
681of aircraft engaged in international air services or to the
682operation and navigation of such aircraft while in the said
683territory shall apply to the designated airline or airlines of
684the other Contracting Party.
6852. The applicable laws and regulations of one Contracting
686Party governing entry into, stay in or departure from its
687territory of passengers, crew, cargo or mail, such as formalities
688regarding entry, exit, emigration, immigration, customs,
689currency, health and quarantine shall apply to passengers, crew,
690cargo and mail carried by the aircraft of the designated airline
691or airlines of the other Contracting Party, while they are within
692the said territory.
6933. Passengers, baggage and cargo in direct transit across the
694territory of either Contracting Party and not leaving the area of
695the airport reserved for such purposes shall, except in respect
696of security measures against acts of violence, air piracy, as
697well as smuggling of narcotic drugs, be subject to no more than a
698simplified control.
6994. In case a carried passenger fails to comply with applicable
700laws and regulations for entry into the country of other
701Contracting Party an airline is obliged to transport him back on
702costs of this airline.
703Article 19
704Applicability to Charter/ Non-scheduled Flights
7051. The provisions set out in Articles 6 (Non-Discrimination in
706respect of charges), 10 (Information and Statistics), 14
707(Taxation and transfer of funds), 15 (Ground Handling), 16
708(Aviation Security), 17 (Aviation Safety), 18 (Application of
709Laws and Regulations), and 20 (Consultations) apply as well to
710charter flights and other non-scheduled flights operated by air
711carriers of one Contracting Party into or from the territory of
712the other Contracting Party.
7132. Paragraph 1 shall not affect national laws and regulations
714governing the authorization of charter flights or non-scheduled
715flights or the conduct of air carriers or other parties
716involved.
717Article 20
718Consultations
719Either Contracting Party may at any time request consultations
720on the implementation, interpretation, application or amendment
721of this Agreement or compliance with this Agreement. These
722consultations, which may be held between aeronautical authorities
723of the Contracting Parties, shall begin within sixty (60) days of
724the date the other Contracting Party receives a request in
725writing, unless the Contracting Parties mutually decide otherwise
726or unless this Agreement provides otherwise.
727Article 21
728Settlement of disputes
7291. If any dispute arises between the Contracting Parties
730relating to the interpretation or application of this Agreement,
731the Contracting Parties shall, in the first place, endeavour to
732settle it by negotiation in accordance to procedure set by
733Article 20.
7342. If the Contracting Parties fail to reach a settlement by
735negotiation, they may agree to refer the dispute for decision to
736some person or body; if they do not so agree, the dispute shall,
737at the request of either Contracting Party, be submitted for
738decision to a tribunal of three arbitrators, one to be nominated
739by each Contracting Party and the third to be appointed by the
740two so nominated. Each of the Contracting Parties shall nominate
741an arbitrator within a period of sixty (60) days from the date of
742receipt by either Contracting Party from the other Contracting
743Party of a notice through diplomatic channels requesting
744arbitration of the dispute by such a tribunal, and the third
745arbitrator shall be appointed within a further period of sixty
746(60) days.
747If either of the Contracting Parties fails to nominate an
748arbitrator within the period specified, the President of the
749Council of the International Civil Aviation Organization may at
750the request of either Contracting Party appoint an arbitrator or
751arbitrators as the case requires. In all cases, the third
752arbitrator shall be a national of a third State and shall act as
753President of the arbitral tribunal. The arbitral tribunal shall
754reach its decision by majority of votes. In all other respects
755the arbitral tribunal shall determine its own procedure.
7563. The Contracting Parties undertake to comply with any
757decisions given under paragraph 2 of this Article.
7584. If and for so long as either Contracting Party fails to
759comply with a decision given under paragraph 2 of this Article,
760the other Contracting Party may limit, suspend or revoke any
761rights or privileges which it has granted by virtue of this
762Agreement to the Contracting Party in defaults.
7635. Each Contracting Party shall bear the expenses and
764remuneration necessary for its arbitrator; the fee for the third
765arbitrator and the expenses necessary for this one as well as
766those due to the activity of the arbitration shall be equally
767shared by the Contracting Parties.
768Article 22
769Amendments
7701. If either of the Contracting Parties desires to modify any
771provision of this Agreement including the Annex, it should be
772after consultation in accordance with Article 20 of this
773Agreement.
7742. This Agreement and its Annex may be modified and
775supplemented by mutual consent of both Contracting Parties. Such
776amendment and supplements shall be made in a form of separate
777protocols being an integral part of this Agreement and shall
778enter into force in accordance with the provisions of Article 25
779of this Agreement.
780Article 23
781Registration
782This Agreement and any amendments thereto shall be registered
783with the International Civil Aviation Organization.
784Article 24
785Termination
786Either Contracting Party may at any time give notice in
787writing through diplomatic channels to the other Contracting
788Party of its decision to terminate this Agreement. Such notice
789shall be simultaneously communicated to the International Civil
790Aviation Organization. This Agreement shall terminate at midnight
791(at local time of the Contracting Party, which has received the
792notice) upon expiration of twelve (12) months from the date of
793receipt of the notice by the other Contracting Party, unless the
794notice is withdrawn by agreement before the end of this period.
795In the absence of acknowledgement of receipt by the other
796Contracting Party, the notice shall be deemed to have been
797received fourteen (14) days after receipt of the notice by the
798International Civil Aviation Organization.
799Article 25
800Entry into force
801This Agreement shall enter into force on the date of receipt
802of the later of notifications the two Contracting Parties have
803notified each other through diplomatic channels that the
804requirements for its entry into force under their respective
805internal procedures have been fulfilled.
806Done at Kuala Lumpur, Malaysia, this 22rd day of
807October, 2024, in two originals in the Latvian, Spanish and
808English languages. All texts being equally authentic. In case of
809divergence of interpretation, the English text shall prevail.

8603. No fifth freedom traffic rights shall be exercised between
861intermediate points or points beyond and the territory of the
862other Contracting Party unless an agreement to that effect is
863made between the two aeronautical authorities of the Contracting
864Parties.
8654. Seventh freedom of air traffic rights shall be allowed
866reciprocally to the airlines of Contracting Parties, for the
867performance of exclusively cargo transport services, in regular
868and non-regular operations, with equal opportunities, without
869restrictions.
8705. Code-Sharing
871In operating or offering the authorised services on the
872specified routes any designated airline of one Contracting Party
873may enter into code-sharing arrangements with
874- an airline or airlines of the same Contracting Party,
875- an airline or airlines of the other Contracting Party,
876or
877- an airline or airlines of a third country, provided that
878such a third country authorises or allows comparable arrangements
879between the airlines of the other Contracting Party and other
880airlines on services to, from and via such a third country,
881provided that all airlines in such arrangements
882- hold the appropriate authority to operate on the routes and
883segments concerned, and
884- in respect of any ticket sold by it or them, make it clear
885to the purchaser at the point of sale which airline will actually
886operate each sector of the service and with which airline or
887airlines the purchaser is entering into a contractual
888relationship.
889Both Contracting Parties concurred that code-share services of
890the marketing carrier should not be counted against the
891bilaterally agreed frequency entitlement.
